Re: Ransom Everglades Middle School Class 11 Permit
Dear Lourdes:
Please accept this letter as a supplement and addition to the Ransom Everglades
Middle School Class II Permit Application for Lot 7, Block A, South Bayshore Drive,
according to the plat thereof, as recorded in Plat Book 2 at Page 6 of the Public Records
of Miami -Dade County, Florida (the "Bellen Property'). As you aware, Ransom Everglades
has been meeting with its neighbors who own portions of Lot 6, Block A, South Bayshore
Drive also known as Banyan Bluff which immediately abuts the Bellen Property to the
north. As a result of those discussions, Ransom Everglades is hereby submitting a set of
additional conditions which we are voluntarily requesting that the City attach to and
incorporate as part of the issuance of the Class II Permit for the Bellen Property. It is the
understanding of Ransom Everglades and the neighbors that or1Ce these conditions are
attached as part of the issuance of the Class 11 Permit for the Bellen Property, that the
neighbors will be able to seek enforcement of these conditions by requesting that the City
enforce the condition and/or, if necessary, appealing the Director's decision to the Zoning
Board in the event of a disagreement between the City and the neighbors as to the
interpretation and/or enforcement of the conditions.
CLASS II PERMIT CONDfTIONS
1. LANDSCAPE ISSUES
Ransom Everglades agrees to install and maintain on a continuing basis the
twenty foot landscape buffer substantially as shown on the plans prepared by Alex Knight

landscape Architecture and Planning as approved by the City of Miami Environmental
Preservation Board (the "Landscape Buffer Plans") including:
Sheet L-1, Overall Site Plan, dated May 14, 1999 with a most recent revision
date of July 19, 2000;
Sheet L-2, North Buffer Tree inventory, dated May 14, 1999 with a most
recent revision date of July 19, 2000;
Sheet L-3, North Buffer Planting, dated July S, 2000 with a most recent
revision date of July 19, 2000; and
Sheet L-4, Planting Notes/Details, dated July 14, 1999 with a most recent
revision date of July 19, 2000,
Ransom Everglades has agreed to attempt to save as many of the existing
trees in the buffer area as will assist in creating the buffer and to continue to meet with the
Banyan Bluff homeowners concerning the installation of the plant materials and may move
and/or supplement the plant material in order to address site specific concerns in the field.
2. CONSTRUCTION RELATED ISSUES
a. Ransom Everglades agrees that prior to beginning construction of the
field, that it will attach a dust barrier to the existing chain link fence
located along the north property line and/or, where necessary, install
a construction fence with dust barrier;
b. Ransom Everglades agrees that no heavy equipment or other noise
generating construction activities will occur on the Bellen Property
before 8:00 a.m. or after 6:00 p.m. on weekdays and that no noise
generating construction activity will occur on weekends;
c. Subject to requirements for protection of the existing bluff and plant
materials on the site, access for construction vehicles from South
Bayshore Drive will be undertaken in such a mariner as to minimize
impact an the Banyan Bluff properties by keeping construction
vehicles as far away from the Banyan Bluff property line as.

Construction workers will not be permitted to park their vehicles on
the Bellen Property and, to the greatest extent possible, will be
required to park in existing school parking facilities;
e. Ransom Everglades agrees to begin construction of the eight foot
concrete block wall as scan as possible once the grading for the area
of the wail is complete;
g•
Ransom Everglades agrees to begin installation of the plant material,
particularly on the north side of the eight foot concrete block wall, as
soon as reasonably possible to take advantage of the remaining
growing season;
Ransom Everglades agrees to replace trees and plant materials as
may be necessary in order to maintain the landscape buffer in-
substantial accordance with the approved Landscape Buffer Plans;
and
Finery, Ransom Everglades agrees to grade its property so as to
comply with the requirements of the South Florida Building Code,
which prohibits overland drainage onto adjoining properties.
3. BELLEN PROPERTY USE RESTRICTIONS
a, The existing roadway connection from the Beiien Property to South
Bayshore Drive shall be eliminated after construction and there shall
be no vehicular access from South Bayshore Drive to the Bellen
Property;
b. Ransom Everglades will install appropriate No Trespassing signs to
discourage any unauthorized use of the Been Property;
c. Ransom Everglades agrees that it will not install lighting or other
Improvements cn the Bellen Property including, but not limited to: no
softball diamond or backstop, no bleachers, no equipment storage or
storage sheds, no loudspeakers or bells, no scoreboard and no
garbage or trash pickup or storage on the Bellen Property;

d. There shall be no parking on the Bellen property at any time including
during special events or on weekends;
e. There shall be no use of the Bellen Property on Sundays:
Saturday use of the Bellen Property for games or special events shall
be limited to no more than nine times per year;
There shall be no upper school football games played on the Bellen
Property. Upper school games for boys' and girls' sports, including,
but not limited to: soccer, softball, and lacrosse shall be limited to no
rnore than twenty four games per year (which is the equivalent of
approximately three games permonth);
h. There shall be no summer school activities on the Bellen Property or -
non school sponsored events on the Belton Property;
i. There shall be no band or cheerleading practice on the Bellen
Property; and
Finally, the Bellen Property shall not be rented for use by non middle
school entities,
We appreciate the City's cooperation in working with us to try to address Ransom
Everglades' neighbors' concerns.
