A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING
THE FINDINGS OF THE EVALUATION COMMITTEE ACCEPTING THE PROPOSAL
OF MERCY MEDICAL DEVELOPMENT D/B/A MERCY OUTPATIENT
CENTER TO PERFORM PRE -EMPLOYMENT PHYSICAL EXAMINATION
SERVICES FOR DESIGNATED PERSONNEL, AT AN ESTIMATED ANNUAL COST
NOT TO EXCEED $136,695, FOR THE INITIAL TWO-YEAR PERIOD, FOR THE
DEPARTMENT OF EMPLOYEE RELATIONS ("EMPLOYEE RELATIONS");
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED
FORM, FOR AN INITIAL TWO-YEAR PERIOD, WITH THE OPTION TO RENEW
FOR TWO ADDITIONAL TWO-YEAR PERIODS, SUBJECT TO THE SAME TERMS
AND CONDITIONS; FURTHER AUTHORIZING AN INCREASE IN COMPENSATION
IN AN AMOUNT NOT TO EXCEED 5% WHICH SHALL BE EFFECTIVE ON THE
FIRST DAY OF ANY OPTIONAL PERIOD; ALLOCATING FUNDS FROM THE
GENERAL OPERATING BUDGETS OF EMPLOYEE RELATIONS, ACCOUNT
CODE NO. 001000.270101.6.260, IN AN AMOUNT NOT TO EXCEED $82,470, THE
DEPARTMENT OF FIRE -RESCUE, ACCOUNT CODE NO. 001000.280401.6.260, IN
AN AMOUNT NOT TO EXCEED $21,480, AND THE DEPARTMENT OF POLICE,
ACCOUNT CODE NO. 001000.290201.6.260, IN AN AMOUNT NOT TO EXCEED
$32,755.
WHEREAS, pursuant to public notice, Request for Proposals ("RFPs") No. 03-04-079 was issued
to perform pre -employment physical examination services for designated personnel, on a contract
basis for two (2) years, with the option to renew for two (2) additional two-year periods, for the
Department of Employee Relations ("Employee Relations"); and
WHEREAS, RFPs were received on April 12, 2004, and three (3) Proposers were deemed
responsive; and
WHEREAS, the proposals were evaluated by an Evaluation Committee appointed by the City
Manager which recommended that the proposal received from Mercy Medical Development, d/b/a
Mercy Outpatient Center, for pre -employment physical examination services, be accepted as the
proposal most advantageous to the City, and the City Manager concurred; and
WHEREAS, funds for these services are available, at a first year cost not to exceed $136,695,
from the General Operating Budgets for the Department of Employee Relations, Account Code No.
001000.270101.6.260; Department of Fire -Rescue, Account Code No. 001000.280401.6.260; and
Department of Police, Account Code 001000.290201.6.260; and
WHEREAS, the City Manager and the Director of Employee Relations recommend that the
proposal received from Mercy Medical Development, d/b/a Mercy Outpatient Center, for the above

services, be accepted as the proposal most advantageous to the City,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The recommendation of the City Manager approving the findings of the Evaluation
Committee accepting the proposal of Mercy Medical Development, d/b/a Mercy Outpatient Center, to
perform pre -employment physical examination services, for designated personnel, at an estimated
annual cost not to exceed $136,695 for the initial two-year period, with the option to extend for two
additional two-year periods, is accepted, with funds allocated from the General Operating Budgets of
Employee Relations, Account Code No. 001000.270101.6.260, in an amount not to exceed $82,460,
the Department of Fire -Rescue, Account Code No. 001000.280401.6.260, in an amount not to
exceed $21,480, and the Department of Police, Account Code No. 001000.290201.6.260, in an
amount not to exceed $32,755.
Section 3. The City Manager is authorized{1} to negotiate and execute a Professional Services
Agreement, in substantially the attached form, and to authorize an increase in compensation in an
amount not to exceed 5% which shall be effective on the first day of any optional period.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
