proposed facility, provided they are registered with the planning, building and zoning department pursuant to section 934.2.1.
10.Cammunity based residential facilities, licensed by FHRS, with from seven (7) to a maximum of fourteen (14) clients (not
including drug, alcohol or correctional rehabilitation facilities and dangerous mentally ill persons) when located at least one thousand
two hundred (1,200') feet from any existing similar facility, or five hundred (500') feet from any single-family district measured from
the nearest point of the site of the existing facility to the nearest point of the site of the proposed facility, provided they are registered
with the planning, building and zoning department pursuant to section 934.2.1.
PERMITTED ACCESSORY USES
1. Wet dockage or moorage parallel to the shoreline for one (1) row for private pleasure craft_
2. Cellular communications site provided that the miscellaneous antennas and all of its appurtenances:
(1) Shall not be visible from ground from a maximum distance of six hundred (600) feet screening from ground view may be
provided by a parapet or some other type wall or screening;
(2) Shall not exceed a height of eighteen (18) feet above the roof,
(3) Shall not be located closer than eight (8) feet to any power line;
(4) Shall not exceed three (3) separate areas per roof top;
(5) Shall be installed and maintained in accordance with all applicable Code requirements; and
(6) Shall not be located on buildings or structures thereon of less than forty-five (45) feet in height.
Notwithstanding the above, if the transmission tower is used in connection with a cellular communications site, the transmission
tower shall be by Special Exception Permit only.
The transmission tower and anchoring devices, if directly -abutting a residential district must:
(1) be located in the interior side or rear yard of the property;
(2) meet minimum setback requirements;
(3) be securely anchored, installed and maintained in accordance with all applicable codes;
(4) not exceed a maximum height of one hundred and fifty (150) feet and
(5) be separated from adjacent t properties by a landscape buffer.
A Special Exception Permit shall not be required if the antennae are located on a self-supporting pole (in lieu of a transmission
tower) of not more than one hundred (100) feet in height.
IN ADDITION, AS FOR R-3 - MULTIFAMILY MEDIUM -DENSITY RESIDENTIAL
1. Detached garages and car shelters
Subject to the criteria requirements and limitations of Section 908.6.
2. Garden sheds.
3. Private piers, docks and boathouses
Subject to the criteria requirements and limitations of Section 924.

OFFSTREET PARKING REQUIREMENTS
1. Offices and other nonresidential uses:
One (1) space per three hundred fifty (350) square feet of gross floor area.
2. Lodgings:
One (1) space per every two (2) lodging units.
3. Multifamily residential uses:
One (1) space for each efficiency/one-bedroom unit.
Two (2) spaces for each two -bedroom unit or each three -bedroom unit.
Three (3) spaces for each unit with more than three (3) bedrooms.
In addition, one (1) space for every ten (10) units or portion thereof designated for visitors.
4. Adult care:
One (1) offstreet parking space shall be required for the owner/operator and one (1) space for each employee. In addition to providinc
offstreet parking, such establishments shall provide safe and convenient facilities for loading and unloading clients including one (1;
unloading space for every ten (10) clients cared for.
5. Child care:
One (1) space for the owner/operator and one (1) space for each employee. In addition to providing offstreet parking, suct
establishments shall provide safe and convenient facilities for loading and unloading children including one (1) unloading space for
every ten (10) children cared for.
6. Convalescent homes, nursing homes, institutions for the aged or infirm and orphanages:
One (1) space for each five (5) beds, plus one (1) space for each dolor in regular attendance, plus one (1) space for each three (3;
employees or volunteers on peak shifts.
7. Places of worship, primary and secondary schools: As for Gill.
For places of worship, a reduction of up to twenty-five (25) percent in required offstreet parking shall be permissible by Special
Exception, when such facilities are located within 1000 feet of a mass transit station or mass transit stop. No other parking reductior
may be used in conjunction with this provision.
OFFSTREET LOADING REQUIREMENTS
For buildings in excess of twenty-five thousand (25,000) square feet and up to five hundred thousand (500,000) square feet of gross
building area:
Berth minimum dimension to be twelve (12) by thirty-five (35) feet
/1. First berth for gross building area up to fifty thousand (50,000) gross square feet
/ 2. Second berth for gross building area of fifty thousand (50,000) up to one hundred thousand (100,000) gross square feet;
3. Third berth for gross building area of one hundred thousand (100,000) up to two hundred fifty thousand (250,000) gross square feet
4. Fourth berth for gross building area of two hundred fifty thousand (250,000) up to five hundred thousand (500,000) gross square feet
For buildings with square footage in excess of five hundred thousand (500,000) square feet of gross building area:

AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A
90-DAY TEMPORARY MORATORIUM ON THE ACCEPTANCE OF
APPLICATIONS FOR NEW BUILDINGS IN EXCESS OF 40 FEET IN HEIGHT
FOR THAT AREA LOCATED IN AND REGULATED UNDER THE SD-9
BISCAYNE BOULEVARD NORTH OVERLAY DISTRICT OF THE ZONING
ORDINANCE AND ZONING ATLAS OF THE CITY OF MIAMI; PROVIDING FOR
A TERM; PROVIDING FOR PENDING APPLICATIONS; PROVIDING FOR
ADMINISTRATIVE AND JUDICIAL REVIEW; CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Biscayne Boulevard Corridor ("Corridor"), in general, and the Upper Eastside
and Edgewater Communities, in particular, are experiencing a metamorphosis accompanied by
intense redevelopment activity; and
WHEREAS, the City has determined that there is a need to study the area and develop
architectural, Urban Design and Streetscape Guidelines for the Corridor; and
WHEREAS, the City retained the Town Planning and Urban Design services of Hellmuth,
Obata and Kassabaum, Inc. HOK
Planning Group, New Urban Studio ("HPG-NUS") to assist the Planning Department in the
Biscayne Boulevard Corridor Study ("Study"); and
WHEREAS, the scope of the Study is to develop the Vision Regulating Plan for the Biscayne
Boulevard Corridor (from 1-395 to the South of Northeast 87th Street to the North) that would
establish a consistent look and feel for this section of the Corridor and its immediate environs,
including the subject Upper Eastside and the Edgewater communities; and
WHEREAS, the study will include full-blown neighborhood Charrettes and production of "Vision
Plans" as well as a "Regulating Plan" portion of the Vision Plan relating to urban and architectural
guidelines, which together with the Envisioned Urban and Architectural Guidelines, will form a
Design Code; and
WHEREAS, the Design Code's Urban Guidelines component will describe disposition, function
and configuration as they relate to their specific urban zones, catalog recommended building types
and illustrate (for each type): building setbacks, parking locations, street cross sections (illustrating
both sides of the Corridor, detailing setbacks, encroachments, heights, permissible users and
special conditions), frontage requirements, etc.; and
WHEREAS, the Design Code will include Architectural Guidelines, as descriptive standards to

promote architectural harmony in the subject area without limiting creativity; and
WHEREAS, the Architectural Guidelines would catalog the vocabulary of buildings, including
roofs, walls, openings and architectural elements; and
WHEREAS, HPG-NUS has produced the requested Biscayne Boulevard Corridor Urban and
Architectural Guidelines in a document dated December 5, 2003; and
WHEREAS, said Urban and Architectural Guidelines are intended to establish a consistent
look and feel for the Corridor and its immediate environs, reinforce its character as a public place,
and direct the evolution of Biscayne Boulevard in a manner that provides a great setting for civic
life of its adjacent neighborhoods and befit the City as a whole; and
WHEREAS, the above -mentioned efforts depend heavily on the ability to create a safe urban
setting by regulating the built environment; and
WHEREAS, The City desires to temporarily halt unrestrained development activity in the
Corridor area pending the implementation of the Study's recommendations by way of promulgation
and adoption of Zoning and other regulations; and
WHEREAS, it is intended that the height guidelines recommended in the Study be an essential
element of the forth -coming regulations;
WHEREAS, a temporary moratorium on the acceptance of applications for certain permits for
new buildings in the Study's area, which are in excess of 40 feet in height, and are to be located in
and regulated under the SD-9 Biscayne Boulevard North Overlay District, will allow for an orderly
remedial effort and requisite studies, without the counteracting impact, which would accompany an
increase, during the remedial process, of the very same matter.
WHEREAS, the Miami Planning Advisory Board, at its meeting of January 21, 2004, Item No.
9, following an advertised hearing, adopted Resolution No. PAB 09-04, by a vote of eight to zero
(8-0), RECOMMENDING APPROVAL of imposing a temporary moratorium on the acceptance of
applications for certain development permits in the SD-9 Biscayne Boulevard North Overlay
District, as hereinafter set forth, and
WHEREAS, the Miami Planning Advisory Board, at the above -
referenced meeting, recommended that the moratorium be increased in duration to 180 days and
further recommended that the height element be reduced further to 40 feet for both commercial
and residential buildings; and

by surveyors, engineers, architects or other professionals.
