HomeMy WebLinkAboutR-04-0473City of Miami Legislation Resolution: R-04-0473 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00815 Final Action Date: 7/8/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING SUBMISSION OF AN APPLICATION TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ("HUD") LEAD -BASED PAINT HAZARD CONTROL GRANT PROGRAM, OFFICE OF HEALTHY HOMES AND LEAD HAZARD CONTROL IN SUPPORT OF THE CITY OF MIAMI'S "MIAMI UNLEADED," NEIGHBORHOOD PROGRAM OF EDUCATION AND OUTREACH WHICH HAS ALREADY RECEIVED THE 2004 U.S. CONFERENCE OF MAYORS' FUNDING AWARD OF $300,000, WHICH WILL BE USED AS MATCHING FUNDS FOR THE HUD GRANT. WHEREAS, the City of Miami ("City") is committed to improving the quality of life of all its citizens; and WHEREAS, environmental hazards such as lead -based paint are barriers reduce the quality of life; and WHEREAS, exposure to lead -based paint are known health hazards, especially so for children under the age of six years; and WHEREAS, the leading cause of lead -based poisoning is exposure to dust from deteriorating paint in housing units built before 1978; and WHEREAS, in the City 81 percent of the homes were constructed before 1979; and WHEREAS, the City's Consolidated Plan FY2004-2009 to HUD finds that housing occupied by lower income households with children offer particularly high risks of lead exposure; and WHEREAS, the deterioration of the paint allows children to peel and eat lead -contaminated flakes; and WHEREAS, the City wishes to apply for $3 Million in grant funding from the Lead -Based Paint Hazard Control Grant Program, U.S. Department of Housing and Urban Development, Office of Healthy Homes and Lead Hazard Control to be matched by $300,000 in existing funds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to submit an application for grant funding to City of Miami Page 1 of 2 File Id: 04-00815 (Version: 1) Printed On: 9/21/2016 File Number: 04-00815 Enactment Number: R-04-0473 the Lead -Based Paint Hazard Control Grant Program, U.S. Department of Housing and Urban Development, Office of Healthy Homes and Lead Hazard Control, in an amount not to exceed $3 Million for "Miami Unleaded." Section 3. (1) The City of Miami further certifies the required 10 percent cash match as well as additional in -kind resources in support of the program; (2) The City will not discriminate against any person on basis of race, color or national origin in the use of any property or facility acquired or developed pursuant to this proposal, and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964) and design and construct all facilities to comply fully with statues relating to accessibility by handicapped persons as well as other federal, state and local laws, rules and requirements. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
