HomeMy WebLinkAboutR-04-0455City of Miami Legislation Resolution: R-04-0455 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00694 Final Action Date: 7/8/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE ACQUISITION OF FUEL COLLARS AND ELECTRONIC COMPONENTS, FOR THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION, FOR THE AUTOMATED COMPUTERIZED FUEL FACILITY (FUEL-O-MAT), FROM AUTOMOTIVE COMPUTERS AND EQUIPMENT, INC., THE SOLE SOURCE DISTRIBUTOR FOR MANUFACTURER RAPAC NETWORK INTERNATIONAL, INC., ON AN AS -NEEDED CONTRACT BASIS FORA ONE-YEAR PERIOD, WITH THE OPTION TO EXTEND FOR TWO ADDITIONAL ONE-YEAR PERIODS, IN AN AMOUNT NOT TO EXCEED $170,000, FOR THE FIRST YEAR, AND AN ANNUAL AMOUNT NOT TO EXCEED $35,000, FOR EACH EXTENSION YEAR, FORA TOTAL CONTRACT AMOUNT NOT TO EXCEED $240,000; ALLOCATING FUNDS FROM THE CAPITAL IMPROVEMENT PROJECT NO. 311850.429401.6.840. WHEREAS, the Department of General Services Administration ("General Services") recently upgraded the City of Miami's ("City") fuel facility which included use of an automated fuel management system, and is seeking to procure additional fuel collars and electronic components for the system; and WHEREAS, the fuel collars and electronic components offer the unique and proprietary feature of "ignition interrupt," which prevents a driver from starting a vehicle while the fueling hose is still in the vehicle as the vehicle will not start, and assures the elimination of "driveaways" which tear out the hose and spill fuel, resulting in costly repairs to the City; and WHEREAS, the Chief Procurement Officer has adopted the finding that Automotive Computers and Equipment, Inc. is the sole source distributor for manufacturer Rapac Network International, Inc., of its fuel collars and electronic components for the automated computerized fuel facility; and WHEREAS, the City Manager and the Director of General Services recommends that the requirements for competitive formal sealed bids be waived and the procurement of the above service as specified be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding of sole source, waiving the requirements for competitive sealed bidding procedures is ratified, approved and confirmed and the acquisition of fuel collars and electronic components, for the Department of General Services, for the automated computerized fuel facility (Fuelomat), from Automotive Computers and Equipment, Inc., the sole source distributor, for a one-year period, with the option to extend for two additional one-year periods, in an amount not to exceed $170,000 for the first year, and an annual amount not to exceed $35,000 for each extension year, for a total contract amount not to exceed $240,000, is authorized, with funds allocated from the Capital Improvement Project No. 311850.429401.6.840. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
