HomeMy WebLinkAboutR-04-0443City of Miami Legislation Resolution: R-04-0443 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00804 Final Action Date: 7/8/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY ATTORNEY TO SEEK INJUNCTIVE RELIEF, OR ANY OTHER ACTIONS IN LAW OR IN EQUITY AGAINST THE MIAMI-DADE COUNTY DIVISION OF ELECTIONS, THE STATE OF FLORIDA, THE FLORIDA LEGISLATURE AND ALL NECESSARY BODIES, TO ENSURE THAT EARLY VOTING SITES ARE MADE AVAILABLE TO ALL ELECTORS IN THE CITY OF MIAMI REGARDLESS OF RACE, ETHNICITY OR GEOGRAPHIC LOCATION; FURTHER AUTHORIZING THE CITY ATTORNEY TO ENGAGE SPECIAL COUNSEL FOR SAID LAWSUIT. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney is authorized to seek injunctive relief or any other action in law or in equity against the Miami -Dade County Division of Elections, the State of Florida, the Florida Legislature and all necessary bodies, to ensure that early voting sites are made available to all electors in the City of Miami regardless of race, ethnicity or geographic location. Section 2. The City Attorney is authorized to engage special counsel for said lawsuit. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1 } If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
