AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES/NONSTANDARD STREET WIDTHS," TO MODIFY THE WIDTH
OF NORTHEAST 9TH STREET BETWEEN NORTHEAST 2ND AVENUE AND
BISCAYNE BOULEVARD, MIAMI, FLORIDA; CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Article V of Chapter 54 of the Miami City Code establishes base building line
locations for all public streets within the City of Miami; and
WHEREAS, Northeast 9th Street between Northeast 2nd Avenue and Biscayne Boulevard was
originally dedicated as a 50-foot wide roadway; and
WHEREAS, the zoned street width of this roadway was increased to 80 feet wide but has not
been dedicated or developed to the 80 foot width; and
WHEREAS, the City Administration's review of this transportation corridor reveals that the current
50-foot wide developed roadway adequately serves the present and future transportation needs of
the public; and
WHEREAS, to accommodate the pedestrian and traffic impacts, utility and access needs
compatible with new development now being realized in the Park West area, a reduction in the zoned
street width of Northeast 9th Street between Northeast 2nd Avenue and Biscayne Boulevard from 80
feet to 50 feet is warranted; and
WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effects
on the reduction of the zoned street width of this section of Northeast 9th Street on their operations
and have no substantial objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 54/Article V/Section 54-190 of the Code of the City of Miami, Florida, as
amended, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths," is
amended in the following particulars:{1}

Sec. 54-190. Nonstandard street widths.
Base building lines shall be located from the centerline as specified for each of the
following streets:

Section 3. All ordinances or parts of ordinances that are or are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 4. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption
thereof.{2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten

effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
