Proposed Emergency Ordinance -Amendment to City Code ratifying and
reaffirming the use of special masters for code enforcement violations as
an alternative enforcement system.
The attached proposed emergency ordinance amends Chapter 2/ Article X
Code Enforcement, Sections 2-811, 2-812, 2-814 through 2-819, 2-821, 2-823 through
2-826, 2-828 through 2-829, and repeal Section 2-822, and add new Section 2-830 of
the City Code to adopt, ratify, and reaffirm the City Commission's prior authorization
of the use of special masters in code enforcement matters, pursuant to Florida Statute
162.03(2). The sections listed previously have been amended to reflect that special
masters will function in the same capacity and will have the same status as the code
enforcement board.
The Florida Legislature has authorized municipalities to use special masters in
lieu of code enforcement boards to hold hearings and assess fines, costs, and liens
against violators of the City Code. Pursuant to Florida Statutes Chapter 162, the City
Commission adopted Resolution No.02-392, April I I, 2002, which allowed for the use
of special masters in lieu of the Code Enforcement Board, in the enforcement of code
violations. This Resolution was adopted to address the severe backlog of code
enforcement cases.
This Ordinance provides for a retroactive date of April 11, 2002, the date the
Resolution appointing special masters to preside over code enforcement cases was
originally passed.
