A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO PROVIDE A FULL REPORT INCLUDING PHOTOS, ON JULY 8,
2004, PERTAINING TO THE PLACEMENT OF TRANSMISSION POLES WITHOUTA
PUBLIC HEARING, NOTICE OR COMMENCEMENT WITH THE PUBLIC, CITY
COMMISSION OR THE COMMUNITY REDEVELOPMENT AGENCY, ALONG THE
PUBLIC RIGHT-OF-WAY OF NORTHWEST 11TH STREET, MIAMI, FLORIDA,
FROM THE OVERTOWN SUBSTATION TO THE RAILROAD SUBSTATION;
FURTHER REQUESTING THE CITY ATTORNEY TO DRAFT AN ORDINANCE TO
PREVENT SUCH FUTURE OCCURANCES, ANYWHERE IN THE CITY OF MIAMI
OF SUCH PERMIT ISSUANCE WITHOUTA"PUBLIC HEARING;" FURTHER
DIRECTING A WRITTEN REPORT WITH DETAILED PHOTOS OF A COMPARISON
OF THE SUBSTATION LOCATED AT NORTHWEST 11TH STREET AND 5TH
AVENUE TO THE SUBSTATION ON NORTHEAST 20TH STREET AND 2ND
AVENUE, MIAMI, FLORIDA.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The City Manager is directed to provide a full report including photos, on July 8, 2004,
pertaining to the placement of transmission poles without a public hearing, notice or commencement
with the public, City Commission or the Community Redevelopment Agency, along the public
right-of-way of Northwest 11th Street, Miami, Florida, from the Overtown substation to the railroad
substation.
Section 2. The City Attorney is requested to draft an Ordinance to prevent such future
occurances, anywhere in the City of Miami, of such permit issuance without a "public hearing."
Section 3. It is directed that a written report with detailed photos of a comparison of the substation
located at Northwest 11th Street and 5th Avenue to the substation on Northeast 20th Street and 2nd
Avenue, Miami, Florida be presented to the City Commission on July 8, 2004.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
