CASE NO. 2004-0764
Pursuant to Article 9, Section 934.1 thru 934.3 of Ordinance 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, the subject proposal to allow a
community based residential facility with fifty (50) beds in the R-3 Multifamily Medium -
Density Residential Zoning District has been reviewed as follows:
NOTE: The Special Exception for the Community Based Residential Facility
requires City Commission approval.
The following findings have been made:
• It is found that the proposed use could be beneficial to the area in providing a needed
service to the community and creating new employment opportunities.
• It is found that the design of the proposed facility is in scale and character with the
surrounding area.
• It is found that the submitted plans depict the required landscaping and open space to
serve the residents of the proposed project; however, proposed palms at the rear open
space area shall be substituted for native shade trees.
• It is found that submitted plans do not clearly show the zoning calculations to
properly analyze the required parking provisions (onsite and offsite). It is also found
that the submitted plans need further information depicting the following; (i) a clearer
identification and distribution of proposed uses, (ii) number of clients for all proposed
uses and (iii) a narrative of how the many different proposed uses will be operated.
• It is found that the plans submitted by the applicant are not completely in compliance
base on the previously mentioned concerns; however, with respect to all other
criteria's listed in Section 1305 of Zoning Ordinance 11000, the proposal has been
reviewed and found to be adequate.
• It is found that upon compliance with the conditions set forth below, this project will
not have any adverse impacts on the surrounding area.
Based on these findings, the Planning and Zoning Department is recommending
approval (not as per plans on file) of the proposed facility with the following
conditions:
1. A new landscape plan, with specifications, must be submitted for review and
approval by the Planning Department prior to the issuance of any building
permit.
2. A new set of plans, depicting distribution of all proposed uses, the number of
clients for said uses and a narrative of the all uses explaining the method of
operation shall be submitted for review and approval by the Zoning and
Planning Department prior to the issuance of a building permit or certificate of
use.
3. A new site plan depicting all required parking provision (onsite and offsite) for
each of the proposed uses prior to the issuance of a building permit or certificate
of use.
