HomeMy WebLinkAboutSp Ex ZB ResoMiami Zoning Board Resolution No.: 2004-0869 Monday, May 10, 2004 Mr. Juvenal Pina offered the following resolution and moved its adoption Resolution: AFTER CONSIDERING THE FACTORS SET FORTH IN SECTION 1305 OF ORDINANCE NO. 11000, THE ZONING BOARD RECOMMENDED APPROVAL TO THE CITY COMMISSION OF THE SPECIAL EXCEPTION AS PART OF A MAJOR USE SPECIAL PERMIT FOR THE 500 BRICKELL PROJECT, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 9, SECTION 915.2, FOR FAA CLEARANCE LETTER FOR THE PROPERTIES LOCATED AT APPROXIMATELY 550 BRICKELL. AVENUE, 41, 47, 51, 57, 59 AND 65 SOUTHEAST 6TH STREET, LEGALLY DESCRIBED AS EXHIBIT "A" (HEREBY ATTACHED), PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; ZONED SD-5 BRICKELL AVENUE AREA RESIDENTIAL -OFFICE DISTRICT AND SD-7 CENTRAL BRICKELL RAPID TRANSIT COMMERCIAL -RESIDENTIAL DISTRICTS. THIS SPECIAL EXCEPTION WAS RECOMMENDED APPROVAL TO THE CITY COMMISSION PER PLANS ON FILE WITH A TIME LIMITATION OF TWENTY-FOUR MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED, SUBJECT TO THE FOLLOWING CONDITIONS BY THE PLANNING AND ZONING DEPARTMENT: 1) THE APPROVAL OF THIS MAJOR USE SPECIAL PERMIT SHALL BE SUBJECT TO THE RECORDATION OF THE FOLLOWING DOCUMENTS PRIOR TO THE ISSUANCE OF SHELL PERMIT FOR THE PROPOSED PROJECT: a) UNITY OF TITLE OR COVENANT IN LIEU THEREOF PROVIDING THAT THE OWNERSHIP, OPERATION AND MAINTENANCE OF ALL COMMON AREAS AND FACILITIES WILL BE BY THE PROPERTY OWNER OR A MANDATORY PROPERTY OWNER ASSOCIATION IN PERPETUITY, b) DEVELOPMENT ORDER SPECIFYING THAT THE DEVELOPMENT ORDER RUNS WITH THE LAND AND IS BINDING ON THE APPLICANT, ITS SUCCESSORS AND ASSIGNS, JOINTLY OR SEVERALLY, 2) THE APPLICANT SHALL SUBMIT A PARKING PLAN FOR CONSTRUCTION EMPLOYEES AND TEMPORARY PARKING ARRANGEMENTS FOR THE EXISTING BUILDING WHILE UNDER CONSTRUCTION; SAID PARKING PLAN SHALL BE SUBJECT TO REVIEW AND APPROVAL BY THE PLANNING AND ZONING DEPARTMENT PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS, 3) THE APPLICANT SHALL PROVIDE PLANS FOR PROPOSED SIDEWALK AND SWALE AREA IMPROVEMENTS PRIOR TO THE ISSUANCE OF A BUILDING PERMIT; SAID PLANS SHALL BE SUBJECT TO REVIEW AND APPROVAL BY THE PUBLIC WORKS DEPARTMENT AND THE PLANNING AND ZONING DEPARTMENT AND 4) THIS APPROVAL SHALL ALSO BE SUBJECT TO ALL ADDITIONAL CONDITIONS SPECIFIED IN THE FINAL DEVELOPMENT ORDER FOR THE PROJECT.
