HomeMy WebLinkAboutZB ResoMiami Zoning Board Resolution No.: 2004-0867 Monday, May 10, 2004 Mr. Carlos Martell offered the following resolution and moved its adoption Resolution: AFTER CONSIDERING THE FACTORS SET FORTH IN SECTION 1305 OF ORDINANCE NO. 11000, THE ZONING BOARD RECOMMENDED APPROVAL TO THE CITY COMMISSION OF THE SPECIAL EXCEPTIONS AS PART OF A SUBSTANTIAL MODIFICATION FOR A MAJOR USE SPECIAL PERMIT FOR THE METROPOLITAN MIAMI PROJECT, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 4, SECTION 401, TO ALLOW FOR BARS, SALOONS, TAVERNS AND/OR SUPPER CLUBS AND ARTICLE 9, SECTION 915.2, FOR FAA CLEARANCE LETTER FOR THE PROPERTIES LOCATED AT APPROXIMATELY 300 SOUTHEAST 3RD STREET, 200 SOUTHEAST 3RD STREET AND 200 SOUTHEAST 2ND STREET, LEGALLY DESCRIBED AS LOTS 1 THROUGH 8, INCLUSIVE, BLOCK 2, TOGETHER WITH ALL OF BLOCKS 3 AND 4, DUPONT PLAZA (50-11), PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; ZONED CBD CENTRAL BUSINESS DISTRICT. THESE SPECIAL EXCEPTIONS WERE RECOMMENDED APPROVAL TO THE CITY COMMISSION PER PLANS ON FILE WITH A TIME LIMITATION OF TWENTY-FOUR MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED, SUBJECT TO THE FOLLOWING CONDITIONS BY THE PLANNING AND ZONING DEPARTMENT: 1) THE APPROVAL OF THIS MAJOR USE SPECIAL PERMIT SHALL BE SUBJECT TO THE RECORDATION OF THE FOLLOWING DOCUMENTS PRIOR TO THE ISSUANCE OF SHELL PERMIT FOR THE PROPOSED PROJECT: a) UNITY OF TITLE OR COVENANT IN LIEU THEREOF PROVIDING THAT THE OWNERSHIP, OPERATION AND MAINTENANCE OF ALL COMMON AREAS AND FACILITIES WILL BE BY THE PROPERTY OWNER OR A MANDATORY PROPERTY OWNER ASSOCIATION IN PERPETUITY, b) DEVELOPMENT ORDER SPECIFYING THAT THE DEVELOPMENT ORDER RUNS WITH THE LAND AND IS BINDING ON THE APPLICANT, ITS SUCCESSORS AND ASSIGNS, JOINTLY OR SEVERALLY, 2) THE APPLICANT SHALL SUBMIT A PARKING PLAN FOR CONSTRUCTION EMPLOYEES AND TEMPORARY PARKING ARRANGEMENTS FOR THE EXISTING BUILDING WHILE UNDER CONSTRUCTION; SAID PARKING PLAN SHALL BE SUBJECT TO REVIEW AND APPROVAL BY THE PLANNING AND ZONING DEPARTMENT PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS, 3) THE APPLICANT SHALL PROVIDE PLANS FOR PROPOSED SIDEWALK AND SWALE AREA IMPROVEMENTS PRIOR TO THE ISSUANCE OF A BUILDING PERMIT; SAID PLANS SHALL BE SUBJECT TO REVIEW AND APPROVAL BY THE PUBLIC WORKS DEPARTMENT AND THE PLANNING AND ZONING DEPARTMENT AND 4) THIS APPROVAL SHALL ALSO BE SUBJECT TO ALL ADDITIONAL CONDITIONS SPECIFIED IN THE FINAL DEVELOPMENT ORDER FOR THE PROJECT.
