HomeMy WebLinkAboutR-04-0418City of Miami Legislation Resolution: R-04-0418 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00645 Final Action Date: 6/24/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A QUIT CLAIM DEED, AS DESCRIBED IN "EXHIBIT B," ATTACHED AND INCORPORATED, FROM THE MIAMI SPORTS AND EXHIBITION AUTHORITY ("MSEA"), FOR THE CONVEYANCE TO THE CITY OF MIAMI OF THE FIRST AVENUE RIGHT-OF-WAY LOCATED WITHIN TRACT "C" OF THE MIAMI ARENA SUBDIVISION, MIAMI, FLORIDA, AS LEGALLY DESCRIBED IN "EXHIBIT A," ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO JOIN WITH MSEA IN THE EXECUTION OF A QUIT CLAIM DEED, AS DESCRIBED IN "EXHIBIT C," ATTACHED AND INCORPORATED, FOR THOSE PORTIONS OF LAND THAT WERE ORIGINALLY DEDICATED TO THE GRAN CENTRAL CORPORATION, PURSUANT TO RESOLUTION NO. 88-471, ADOPTED MAY 19, 1988, AND ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 88-471, adopted May 19, 1988, the City of Miami ("City") by Quit Claim Deed, dedicated the land legally described in "Exhibit A," attached and incorporated, to the Gran Central Corporation in accordance with the realignment of Northwest 1st Avenue, Miami, Florida; and WHEREAS, said deed was never recorded in the public records of Miami -Dade County Florida; and WHEREAS, the City realigned First Avenue, platted the Miami Arena Subdivision and dedicated to the Miami Sports and Exhibition Authority, Tracts "A," "B," and "C" of the Miami Arena Subdivision; and WHEREAS, there is a possibility of a title defect which can only be cured by the joinder of MSEA and the City in a Quit Claim Deed to the Gran Central Corporation, its successor or assigns of any interest that the City may have in the land previously dedicated to Gran Central Corporation; and WHEREAS, the MSEA Board of Directors passed a Resolution authorizing the execution of the Quit Claim Deed at its meeting of May 25, 2004; and WHEREAS, it is necessary for the City Manager to re -execute a Quit Claim Deed to the Gran Central Corporation and its successors or assigns, in accordance with Resolution No. 88-471 immediately; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by City of Miami Page 1 of 2 File Id: 04-00645 (Version: 1) Printed On: 9/16/2016 File Number: 04-00645 Enactment Number: R-04-0418 reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept a Quit Claim Deed, as described in "Exhibit B," attached and incorporated, from MSEA for the conveyance to the City of the First Avenue Right -of -Way located within Tract "C" of the Miami Arena subdivision, Miami, Florida, as legally described in "Exhibit A," attached and incorporated. Section 3. The City Manager is authorized{2} to execute a Quit Claim Deed, as described in "Exhibit C," attached and incorporated, for those portions of land that were originally dedicated to the Gran Central Corporation, pursuant to Resolution No. 88-471, adopted May 19, 1988, and any other necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{3} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {3} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
