"LEMON CITY DAYCARE CENTER (FOURTH B DDINGI. B-6272A"
This first Amendment to the Contract for the project entitled "LEMON CITY DAYCARE CENTER
(FOURTH BIDDING), B-6272A" between the Contractor and the City, awarded to the Contractor by
informal solicitation, authorized by the City Commission Resolution No. 03-551, on May 22, 2003, which
is deemed as being incorporated by reference as if set for in full herein, is entered into this day of
2004, by and between the City of Miami, a municipal corporation of the State of Florida
(the "City"), and "Professional General Contractors, Inc.", a Florida corporation ("Contractor") for the
purpose of amending that certain Contract dated September 17, 2002 between the City and the Contractor
(the "Contract") as set forth herein.
RECITALS:
WHEREAS, pursuant Resolution No. 03-551, adopted by the City Commission on May 22, 2003,
the City and the Contractor entered into the Contract for all labor, materials and equipment and perform
all the work in the form and manner provided by the Contract Documents for the project entitled
"LEMON CITY DAYCARE CENTER (FOURTH BIDDING), B-6272A" and
WHEREAS, the City shall pay to the Contractor, (as provided in the attachment "A" and other
Contract Documents for this project, the sum of ($542,000.00)4 Five Hundred Forty Two Thousand
Dollars; and
WHEREAS, while conducting the construction of the proposed work additional requirements fromr::,
Miami -Dade County Department of Public Health shall by comply as well as unforeseen conditions under;`"
the contract "Lemon City Daycare Center (Fourth Bidding), B-6272A"; and
WHEREAS, the additional work, and materials are required to complete the proposed work in an
estimated amount of ($25,000) Twenty Five Thousand Dollars; and
WHEREAS, the City Commission, by Resolution No. , adopted on June 24th, 2004, has
authorized an increase in the amount of the Contract in ($25,000) Twenty Five Thousand; and
NOW THEREFORE, in consideration of the foregoing and of the mutual agreements and covenants of
the parties as set forth in the Contract, the City and the Contractor agree as follows:
Comp paadoo: Article 2 of the Contract is hereby amended to increase the amount of compensation from
$542,000.00 to $567,000.00; the additional amount to be used exclusively for the payment of the additional
work due to additional requirements from Miami -Dade County Department of Public Health and unforeseen
conditions.
