Submerged Land Lease with the
Board of Trustees of the Internal
Improvement Trust Fund

RECOMMENDATION
The administration recommends that the Miami City Commission adopt the attached Resolution
authorizing the City Manager to execute a Submerged Land Lease Agreement, in substantially the
attached form, between the City of Miami and State of Florida, Board of Trustees of the Internal
Improvement Trust Fund for the City's use of submerged lands adjacent to the City -owned parcel of land
located at 601 NW 7'h Street, Miami, Florida, a/k/a Spring Garden Point Park (the "Park"), with a term of
ten (10) years without fees to the City.
BACKGROUND
On January 23, 2003, the City Commission adopted Resolution 03-081 authorizing the City Manager to
submit a joint application with Miami -Dade County Department of Environmental Resources
Management (DERM) to the Florida Inland Navigation District (FIND) for the funding of environmental
restoration of Spring Garden Point Park. Part of the scope of work for the project is the reconstruction of
a 145-foot dock, installation of a 152-foot dock, construction of a wetland area, installation of a
boardwalk, excavation, and shoreline stabilization for the park. The project is estimated to cost
approximately $276,000 with funding sources coming from a FIND Grant of $138,000 and DERM.
matching funds of $138,000. The department overseeing the construction of the project is DERM in
cooperation with the Department of Parks and Recreation.
During the permitting process, the State of Florida required the City to execute a submerged land lease
agreement to approve the reconstruction and installation of new docks within submerged land owned by
the State and the operation of two (2) public marginal docking facilities. While the City negotiated the
aforesaid lease with the State, Florida Department of Environmental Protection (FDEP) issued a
temporary permit to South Florida Water Management District (SFWMD) authorizing a monitoring
station within a portion of the lease area. SFWMD has now vacated the site and the State can proceed in
offering this submerged land lease to the City.
Financial Impact: There is no impact to the general fund of the City since the funding sources for
the project are from a FIND grant and DERM funds. Additionally, there are no fees payable to the
State of Florida associated with the execution of the submerged land lease agreement. However, in
the event the City changes the use of the docks from temporary moorings to rental of wet slips, it
will require State approval and a fee to the State will be applicable subject to the Florida
Administrative Code 18-21.011 (1)(b).
