Specifically, the applications seek amendment of the Future Land Use Map ("FLUM") designation of the Properties from Medium Density Restricted Commercial to Restricted Commercial, and a change of zoning from T5-0 to T6-8-0. The Properties contain approximately 40,583 square feet (or 0.9 acres) located on the west side of SW 37th Avenue south of the intersection of SW 37th Avenue and SW 28th Street. The Properties consist of six platted lots' improved with 10 dwelling units distributed among five duplex structures. The proposed applications meet the minimum requirements pursuant to Miami 21, Section 7.1.2.8. The requested T6-8-0 zoning is successional to the existing T5-0 zoning, according to the Successional Zoning Table in Section 7.1.2.8.a.3 of Miami 21. The Properties already abut T6-8-0 zoning to their north, and therefore the proposed applications would result in the extension of an existing Transect boundary. However, the Properties also contain more than 40,000 square feet of land area and feature more than 300 linear feet of frontage along SW 37th Avenue. This TOD area was formerly characterized by industrial development, but has since blossomed into a thriving mixed -use center of activity anchored by the Station. New residential buildings, hotels, offices, and commercial uses have transformed the area to where one can live, work, play, and travel without reliance on a personal automobile. The center -point of the TOD's transformation is highlighted by the 39-story, 1,375-unit Link at Douglas development which also contains 280,000 square feet of office space and 68,000 square feet of retail space. This center of activity also seamlessly transitions to the Merrick Park area of Coral Gables, located just west. Metrorail provides convenient car -less connection to major destinations and employment centers like the Urban Central Business District (Brickell and Downtown), as well as Dadeland Mall, the University of Miami, and the health district. Metrorail also connects the area to the Brightline at Miami Central Station, Tri-Rail, Amtrak and Miami International Airport at the Miami Intermodal Center. Finally, the Coral Gables Trolley operate a stop within walking distance of the TOD, affording connection to downtown Coral Gables, another major employment center. PZ-22-13173 02/10/23 SW 37th Avenue is a major corridor that extends the TOD northward with commercial FLUM and zoning designations on both sides of the avenue and other supporting services. The commercial FLUM pattern appears to the north and south of the Properties, including T6-8-0 adjacent to the north. The Properties also benefit from close proximity, across NW 37th Avenue, to Douglas Park, a 10-acre citywide park with sports fields, basketball and tennis courts, and playgrounds. The properties to the west are designated T3-0, overwhelmingly characterized by rental duplexes. Of the sixty closest lower density properties to the Properties, only about one-third are homestead properties. Though these statistics may indicate that the area to the west is not a well - established or stabilized neighborhood, the Owners have committed to ensure that these areas are shielded from incompatible uses. Restrictions voluntarily proffered by the Owners limit a number of disruptive and intrusive non-residential uses at the Properties. The list of prohibited uses includes noise -intensive uses like all types of alcohol service establishments. Also prohibited are uses that would be undesirable near lower density residential properties such as liquor package stores, and any auto -related uses like gasoline stations or service work. A copy of the proffered restrictions is enclosed as Exhibit 1. Further, Miami 21 provides protection for lower intensity neighbors in these exact situations. Through increased setbacks from lower intensity neighbors, the most significant impacts of additional height and massing are mitigated. These protections ensure that if approved, the applications will respect all of the neighboring areas and will remain compatible. The SW 37th Avenue itself is a major section -line thoroughfare with excellent connectivity to transit to the rest of the county and beyond. Bus stops are located less than 500 feet from the Properties on SW 37th Avenue. Either directly or through changing buses, convenient car -less transit is available to all countywide points of interest and even into Broward County. Of course, the close proximity to the Station provides even more wide -spread connectivity. Policy TR-111:As an Urban Infill Area (UIA) and/or a Transportation Concurrency Exemption Area (TCEA) established byMiami-Dade County, Laws and Regulations, and illustrated in Appendix TR-1, Map TR-134 of the Data and Analysis, the City will encourage the concentration and intensification of development around centers of activity with the goal of enhancing the livability of residential neighborhoods, supporting economic development, and the viability of commercial areas. Infill development on vacantparcels, adaptive reuse of underutilized land and structures, redevelopment of substandard sites, downtown revitalization, and development projects that promote public transportation will be heavily encouraged. (See PolicyLU-L1.11.) The area surrounding the Station is becoming a significant commercial destination with employment, retail, and dining establishments that are anchored by the Station. The Properties' close location, with a T6-8-0 zoning designation, provides an opportunity to contribute a walkable development that will support public transit ridership. The Properties are also served by connectivity via public transit buses along SW 37th Avenue/Douglas Road to countywide destinations including Coral Gables, and Miami International Airport. Policy TR-113- Through application of the provisions of its land development regulations, the City will encourage residential development near large employment centers in order to minimize commutes within the City and investigate opportunities for mixed -use developments. The requested T6-8-0 zoning will facilitate appropriate mixed -use development in close proximity to the Douglas Road Metrorail TOD, which provides car -less connectivity to major employment centers in the Urban Central Business District, the Health District, and others via the Metrorail and busses. Additional destinations are available by buses running directly in front of the Properties along SW 37th Avenue and the Coral Gables Trolley available within the TOD area. Increasing density close to mass transit stations, as proposed by this Application, is an ideal way to promote mass transit ridership. Policy TR-115: The City will encourage new development to be structured to reinforce a pattern of neighborhoods and urban centers by focusing growth along transit corridors and around transit nodes and centers. The Station has sprouted a significant transit node offering a vibrant mix of multi -family, office, commercial and restaurant uses. One of many newer and exciting developments, the Link at Douglas project alone has brought 1,375 residential units, 280,000 square feet of office space, and 68,000 square feet of retail space. The Properties are located just over 1/4 mile away. Appropriately increased density at the Properties will contribute to the node and reinforce it, as well as the commercial developments along the SW 37th Avenue/Douglas Road corridor. Policy TR-2,13: The City will encourage increased density of development within walking distance of transit corridors and Metrorail stations (as referenced in Policy LUL1,10, and HO-119) and Policy TR-2L 4. Increase the density of development within walking distance of rapid transit stations in a manner appropriate to the particular setting of each transit station and existing abutting residential neighborhoods are to be protected and preserved The proposed MCNP amendment and rezoning directly addresses the city's goal of increased density within walking distance of Metrorail stations. The Properties are within the Douglas Road Metrorail Station TOD, and are located approximately ten minutes' walk from the station, along SW 37th Avenue/Douglas Road. The Properties front this thoroughfare and are surrounded to the north, south and east by commercially zoned areas that line both sides of the avenue from the station until reaching 22nd Street/Coral Way. Adjacent to the north of the Properties are properties which already have the Restricted Commercial designation and T6-8-0 zoning that are requested for the Properties. The applications do not expand the commercial corridor into any adjacent residential neighborhood. However, to ensure compatibility, restrictions voluntarily proffered by the Owners limit a number of disruptive and intrusive non-residential uses at the Properties. Miami 21 also limits impacts to lower intensity neighbors through increased setbacks. These protections ensure that if approved, the residential areas adjacent will remain protected and preserved.
