ENCLOSURES: Ad of Notice of Public Hearing Enclosed, you will find a public hearing notice advertisement for the City Commission's session scheduled for March 14, 2024. This pertains to the proposed use of city -owned owned property situated at 3501 Rickenbacker Causeway, Miami, Florida 33149. The objective of this public hearing is to discuss Botech Marine Center, Inc. intentions to operate a boat repair and maintenance business on the premises, which will include servicing and caring for boats, boat engines, and systems. Please place the ad in accordance with public hearing requirements of the City Commission and in accordance with section 166.041(3)(c)(2), Florida Statues. Thank you for your assistance. Spring, CFO/Assistant City Manager Date: 2/21/24 CITY OF MIAMI, FLORIDA NOTICE OF PUBLIC HEARING A public hearing will be held by the City Commission of the City of Miami, Florida on Thursday, March 14, 2024, at 9:00 A.M. at City Hall, located at 3500 Pan American Drive, Miami, Florida, 33133 for the purpose of granting the following: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S RECOMMENDATION AND FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A", THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A REVOCABLE LICENSE AGREEMENT ("LICENSE"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI ("CITY") AND BOTECH MARINE CENTER, INC. ("LICENSEE") FOR THE LICENSEE'S USE OF PORTION OF CITY OWNED PROPERTY LOCATED AT 3501 RICKENBACKER CAUSEWAY, MIAMI, FLORIDA 33149 FOR THE PURPOSE OF OPERATING A BOAT REPAIR AND MAINTENANCE BUSINESS, INCLUDING SERVICING AND CARE OF BOATS, BOAT ENGINES AND SYSTEMS FOR A MONTHLY USE FEE OF FOUR THOUSAND TWO HUNDRED FIFTY-TWO DOLLARS AND FFITY CENTS ($4,252.50.) PLUS TAXES, WHICH COMPRISES A REPAIR SHOP ("AREA 1") AND BOAT DOCK RACKS AREA ("AREA 2"), COLLECTIVELY REFERRED TO AS THE PREMISES, WITH A GUARANTEE DEPOSIT OF EIGHT THOUSAND FIVE HUNDRED FIVE DOLLARS AND ZERO CENTS, FOR AN INITIAL TERM OF ONE- YEAR, WITH A THREE PERCENT (3%) INCREASE IN BOTH THE MONTHLY USE FEE AND GUARANTEE DEPOSIT, IF APPLICABLE WITH TERMS AND CONDITIONS AS MORE SPECIFICALLY SET FORTH IN SAID AGREEMENT; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY. The Miami City Commission requests all interested parties be present or represented at the meeting and may be heard with respect to any proposition before the City Commission in which the City Commission may take action. Should any person desire to appeal any decision of the City Commission with respect to any matter to be considered at this meeting, that person shall ensure that a verbatim record of the proceedings is made including all testimony and evidence upon which any appeal may be based (F.S. 286.0105). Pursuant to Miami City Code Section 2-33(o), whenever a scheduled City Commission meeting is cancelled or is not held due to a lack of a quorum or other emergency, a special City Commission meeting will be automatically scheduled for the Tuesday immediately following the cancelled meeting. In the event of one of the aforementioned circumstances, the special meeting would be held on March 19, 2024, at 9:00 a.m. in the City Commission chambers located at Miami City Hall, 3500 Pan American Drive, Miami, Florida 33133. All of the scheduled agenda items from that cancelled meeting shall automatically be scheduled as an agenda item at the special City Commission meeting. The City Clerk shall notify the public of the special meeting that is to take place by placing a notice of the special City Commission meeting at the entrance of City Hall and the City's main administrative building, placing a notice on the City's website, and, if feasible, placing an ad in a newspaper of general circulation before the special meeting on the immediately following Tuesday. There shall be no additional notice by publication required for any such scheduled agenda item that is moved to the special City Commission meeting. In accordance with the Americans with Disabilities Act of 1990, persons needing special accommodations to participate in this proceeding may contact the Office of the City Clerk at (305) 250-5361 (Voice) no later than five (5) business days prior to the proceeding.
