Girnenez City Manager CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM OA1E; March8, 2002 Fu.E: sLIr�ECr ; Emergency Request — Replacement of Gi a Trap for Crown Supermarket REFERENCES : ENCLOSURES: It is respectfully requested that you designate expenditures for replacement of theot er plumbing related items, in Crown Supermarket at the Overtown Shopping Center on aemergency �ic �PPB On December 10, 2001, the Office of Asset Management received a copy of a Motion to Enforce the Stipulated Settlement to replace the grease trap in Crown Supermarket at the Overtown Shopping Center bon Mr. Ricardo Corona, owner of Crown Supermarket. Thin Motion derived from an April 1995 lawsuit filed by Mr. Corona against the City that was subsequently settled in a Court approved Stipulated Settlement and Agreed Order between the City of Miami and Overtown Ventures, Inc. Terms of the Stipulated Settlement Agreement required the City to hire an expert contractor or engineer, at its sole expense, to determine if the grease trap was properly designed andlor installed. The City Commission reecntly approved Emergency Ordinance No. 12170, which includes funding for this project. The Office of Asset Management has worked diligently with the Public Works Department in an effort to resolve this matter. As a result of this joint effort, funds have been identified in the amount of000. The budget for funding this project is located in Project Code 311062, under Index code 819901. Public Works has hired a pre -qualified engineering firm from its procurement list, Milian, Swain, and Associates, Inc., and has received a report and quote of the amount that would be needed to replace the grease trap and other plumbing related items. In order to be in compliance with the Court approved Settlement Agreement, we need to replace the grease trap and other plumbing related items expeditiously. Your signature below will authorize the expenditµre of funds • to replace the grease trap and other plumbing related items at a cost not to exceed S60,000 on an emergency basis.
