RECOMMENDATION
The Administration recommends that the City Commission adopt the attached Resolution,
authorizing the City Manager to declare surplus the City -Owned property located at 1390 NW
24th Avenue, Miami, Florida, (the "Property"), as more particularly described in Exhibit "A"
attached and made a part hereof; designating Allapattah Community Action, Inc., a Florida Not -
For -Profit Corporation ("Purchaser/Developer"); to undertake the development of a HUD
Section 202 Affordable Housing for the elderly. Further authorizing the City Manager to
execute a Purchase and Sale Agreement, in substantially the attached form, with a minimum
purchase price of Two Hundred Forty Eight Thousand One Hundred Forty One Dollars ($248,141.00),
pending verification of construction cost estimates, and to consummate such transaction in
accordance with the terms and conditions of the Agreement, which terms may be solely amended
by the City Manager, as may be necessary in order to effect such sale in an expeditious manner.
BACKGROUND
On February 25, 2003, the City Commission adopted Motion 03-147 instructing the
administration to review and make a recommendation regarding the Property for designation and
proposed future sale to Allapattah Community Action, Inc., a Florida not -for -profit Corporation
("Purchaser/Developer") for the development of elderly affordable housing ("Facility"). On
March 12, 2003, the City of Miami received a letter from Purchaser expressing an interest in the
conveyance of the City -owned Property for the development of 64 elderly housing units. The
Purchaser/Developer has since submitted preliminary site plans and has indicated their intention
to increase the development to a maximum of 80 elderly housing units.
The City of Miami has a severe shortage of affordable housing for the elderly. Section 29B of
the City of Miami Charter exempts affordable housing developments from the competitive
bidding requirements. In an effort to promote the development of new affordable housing in the
City, the City Administration recommends the sale of the Property to Purchaser on the condition
that the Property shall only be used to provide elderly housing for individuals and/or family
within the economic affordability range of very low, low and/or moderate income families and/or
individuals, based on criteria established by federal and/or state law.

On February 26, 2004 the City Commission amended Ordinance No. 11000 to change the current
zoning of the subject site from PR, Parks and Recreation to R-3, Multifamily Medium -Density
Residential to assist the Developer in the development of the Facility. The Property is
approximately 1.6 acres, sits vacant, represents a maintenance cost and liability to the City, and
does not generate ad valorem taxes.
The Purchase and Sale Agreement contains the following conditions precedent to the conveyance
of the Property:
1) The Purchaser shall have been awarded HUD 202 Funding, and shall provide proof of
acceptance of the award, within eight (8) months of the Effective Date.
2) The Purchaser shall complete the HUD Closing.
3) The Purchaser shall agree to all conditions and restrictions imposed by HUD in
accordance with the HUD 202 Program funding.
FINANCIAL IMPACT:
There is no financial impact to the General Fund of the City, as $248,141.00 will be
de sited with the Affordable Housing Trust Fund of the City.
