Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the
City of Miami, Florida, the subject proposal has been reviewed for Variances as follows:
ORIGINAL REQUEST:
Variance for building footprint: Required - 40% or 3,334 s.f
Proposed - 66% or 5,533 s.f.
Request to waive —26% or 2,199 sf.
Variance for parking: Required - 87 parking spaces.
Proposed - 0 parking spaces.
Legal nonconforming credit - 8 parking spaces.
Request to waive — 79 parking spaces.
Variance for green space:
PROPOSED REQUEST:
Required - 10% or 833 s.f.
Proposed - 7% or 500 s.f.
Request to waive - 3% or 333 sf.
Variance for building footprint: Required - 40% or 3,334 s.f.
Proposed - 50% or 4,217 s.f.
Request to waive — 10% or 833 sf.
Variance for parking: Required - 58 parking spaces.
Proposed - 0 parking spaces.
Legal nonconforming credit - 8 parking spaces.
Request to waive — 50 parking spaces.
The following findings have been made:
• It is found that the requested increase of the building footprint is substantially smaller
than the original 26% request; however since the proposal is new construction, it
should be designed to comply with all zoning requirements.
• It is found that even though the original request to waive 79 parking spaces has been
reduced to 50 parking spaces, the parking deficit could still have an adverse impact
unless the applicant provides the required 50 parking spaces through an approved
parking agreement that would prevent from the potential adverse effect of overflow
parking having to be accommodated on adjacent residential streets.
• It is found that by developing the lot in the manner reflected, the property owner will
derive undue benefit under the Zoning Ordinance.
• It is found that since this proposed addition is new construction, it should be designed
to comply with all zoning requirements.
Based on these findings, the Planning and Zoning Department is recommending
denial of the application as presented.
