HomeMy WebLinkAboutR-04-0356City of Miami Legislation Resolution: R-04-0356 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00507 Final Action Date: 5/27/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE REVISED CITY OF MIAMI ("CITY") LOCAL HOUSING ASSISTANCE PLAN ("LHAP"), ATTACHED AND INCORPORATED, FOR THE PERIOD OF JULY 1, 2001 THROUGH JUNE 30, 2004, FOR THE CONTINUED PARTICIPATION OF THE CITY IN THE FLORIDA STATE HOUSING INITIATIVES PARTNERSHIP ("SHIP") PROGRAM; AUTHORIZING THE CITY MANAGER TO INCREASE THE MAXIMUM AMOUNT OF ASSISTANCE PROVIDED TO ANY APPLICANT IN THE FORM OF LOANS AND GRANTS, TO AN AMOUNT NOT TO EXCEED $83,000; AUTHORIZING THE CITY MANAGER TO SUBMIT A MODIFIED PLAN FOR REVIEW AND APPROVAL BY THE FLORIDA HOUSING FINANCE CORPORATION ("FHFC"); FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE TERMS AND CONDITIONS OF THE SHIP AND LHAP PROGRAMS. WHEREAS, in July 1992, the State of Florida ("State") enacted the William E. Sadowski Affordable Housing Act ("Sadowski Act"), which provides for the allocation of a portion of new and existing documentary stamp taxes on deeds on real estate transactions to local governments for the development and maintenance of affordable housing; and WHEREAS, the Sadowski Act provided a dedicated revenue source for affordable housing and created the State Housing Initiatives Partnership ("SHIP") Program; and WHEREAS, in August 1994, the City of Miami ("City") was notified by the State that the City would be eligible to receive SHIP Program funds in the amount of $1,353,387, beginning with the State's 1995-96 Fiscal Year; and WHEREAS, Resolution 04-0152, adopted on March 11, 2004, approved an amendment to the Local Housing Assistance Plan ("LHAP") 2001-2004 and its submission to the Florida Housing Finance Corporation ("FHFC"); and WHEREAS, upon review of the report by the FHFC and their audit of past expenditures, the FHFC recommended that the plan be changed to authorize the highest amount spent repairing an applicant's home to $83,000 for the period of 2001-2004; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The revised City's LHAP, attached and incorporated, for the period of July 1, 2001 City of Miami Page 1 of 2 File Id: 04-00507 (Version: 1) Printed On: 9/14/2016 File Number: 04-00507 Enactment Number: R-04-0356 through June 30, 2004, for the City's continued participation in the SHIP Program, is approved. Section 3. The City Manager is authorized{1} to increase the maximum amount of assistance provided to any applicant in the form of loans and grants, to an amount not to exceed $83,000. Section 4. The City Manager is authorized{1} to submit a modified plan for review and approval by the FHFC. Section 5. The City Manager is further authorized{1} to execute all necessary documents, in a form acceptable to the City Attorney, to implement the terms and conditions of the SHIP and LHAP Programs. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor {2}. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
