HomeMy WebLinkAboutR-04-0348City of Miami Legislation Resolution: R-04-0348 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00537 Final Action Date: 5/27/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION AMENDING RESOLUTION NO. 02-19, ADOPTED JANUARY 10, 2002, WHICH AUTHORIZED THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT ("PSA") WITH DUANY, PLATER-ZYBERK AND COMPANY, PROFESSIONAL CONSULTANTS, SELECTED FROM THE LIST OF PRE -APPROVED TOWN PLANNING/URBAN DESIGN SERVICES FIRMS FOR THE PROJECT ENTITLED "MIAMI MASTER PLAN," INCREASING THE CONTRACT TO A TOTAL COMPENSATION AMOUNT NOT TO EXCEED $1.7 MILLION, BASED ON THE TERMS AND CONDITIONS SET FORTH IN THE PSA WITH DUANY, PLATER-ZYBERKAND COMPANY PURSUANT TO SAID RESOLUTION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, FOR SAID PURPOSE; AMENDING RESOLUTION NO. 02-19 TO REFLECT SAID INCREASE; ALLOCATING FUNDS, IN AN AMOUNT NOT TO EXCEED $1.7 MILLION FOR SERVICES AND EXPENSES TO BE INCURRED BY THE CITY OF MIAMI FROM CAPITAL IMPROVEMENTS PROGRAM PROJECT NO. 311047, ENTITLED "EFFICIENCY IMPROVEMENT STUDIES," WITH AN AMOUNT NOT TO EXCEED $1.2 MILLION AVAILABLE TO BE USED IN FISCAL YEAR 2004, AND APPROPRIATING AN AMOUNT NOT TO EXCEED $500,000, IN THE FISCAL YEAR 2005 BUDGET. WHEREAS, the City of Miami ("City") Administration has determined that it requires to amend Resolution No. 02-19, adopted January 10, 2002, to increase the contract amount for professional services for the project entitled "Miami Master Plan," in an amount not to exceed the sum of $1.7 million; and WHEREAS, Duany, Plater-Zyberk and Company, a professional consultant firm with a town planning/urban design services agreement with the City dated February 4, 2003, pursuant to Resolution No. 02-19, adopted January 10, 2002; and WHEREAS, Duany, Plater-Zyberk and Company has been selected for town planning/urban design services for the project, Miami Master Plan; and WHEREAS, funds for these services and expenses are available from Capital Improvements Project No. 311047, entitled "Efficiency Improvement Studies," in an amount not to exceed $1.2 million, is available to be used in Fiscal Year 2004, and $500,000 will be appropriated in the Budget for Fiscal Year 2005; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Resolution No. 02-19, adopted January 10, 2002, which authorized the City Manager to execute a Professional Services Agreement with Duany, Plater-Zyberk and Company ("DPZ"), professional consultants, selected from the list of pre -approved town planning/urban design services firms, for the project entitled, "Miami Master Plan," is amended and the increase in the contract to a total compensation amount not to exceed $1.7 million, is authorized. Section 3. The City Manager is authorized{1} to execute an amendment to the PSA between Duany, Plater-Zyberk and Company and the City, dated February 4, 2003, to increase their total compensation amount to a guaranteed maximum of $1.7 million. Section 4. Funds for said increase are available from Capital Improvements Project No. 311047, entitled "Efficiency Improvement Studies" $1.2 million is available to be used in Fiscal Year 2004 and an amount not to exceed $500,000, will be appropriated in the Budget of Fiscal Year 2005. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
