RECOMMENDATION:
The administration recommends that the City Commission adopt the attached Resolution authorizing the
City Manager to declare surplus and execute a Purchase and Sale Agreement ("Agreement"), in
substantially the attached form, for the sale of the City owned properties located at 3840 Washington
Avenue and 3850 Washington Avenue, Miami, Florida (the "Properties"), to Ardent Housing
Foundation, Inc., a Florida Not -for -profit Corporation, (Purchaser); establishing Ten Dollars ($10) as the
amount to be paid to the City of Miami by Purchaser for the Properties and to consummate such
transaction in accordance with the terms and conditions of the Agreement, which terms may be solely
amended by the City Manager as may be necessary in order to effect such sale in an expeditious manner.
BACKGROUND:
On December 4, 2003 the City of Miami received a letter from The Center for Urban and Community
Design ("CUCD") expressing an interest in having the City -owned properties located at 3840
Washington Avenue and 3850 Washington Avenue, respectively containing approximately 1,750 square
feet, deeded to Ardent Housing Foundation for the ability to develop affordable housing in Coconut
Grove. The City of Miami has a severe shortage of housing within the affordability range for families
and individuals of very low, low, and moderate -income. Currently the properties sit vacant, represent a
maintenance cost and liability to the City, and do not generate ad valorem taxes.
Section 29B of the City of Miami Charter exempts affordable housing developments from the
competitive bidding requirements. City will agree to sell the Properties to Purchaser on the condition
that the Properties shall only be used to provide one (1) owner occupied single family home for
individuals and/or family within the economic affordability range of very low, low, and/or moderate
income families and/or individuals, based on criteria established by federal and/or state law.
The Purchase and Sale Agreement shall contain the following conditions precedent to the conveyance of
the Properties: 1) Purchaser shall furnish to the City evidence that it has the funds necessary to construct
the improvements; 2) Purchaser has agreed to work, in good faith, with the Coconut Grove Collaborative,
Inc., in order to secure a buyer for the improved Properties who satisfies the applicable affordable
housing income test requirements and Purchaser shall submit to the Seller evidence of same; 3) Purchaser
shall obtain the necessary zoning approval to construct a single family home on the two lots; 4) Purchaser
shall submit a copy of the construction contract for the construction of the improvements; and 5)
Purchaser shall furnish evidence that it is ready to commence construction within six (6) months from the
date of closing and to complete construction of the improvements within twelve (12) months of
commencement.
