A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTER -LOCAL
AGREEMENT ("AGREEMENT") WITH MIAMI-DADE COUNTY ("COUNTY"),
CONSISTING OF A NON -BINDING AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH THE COUNTY TO IMPLEMENT A SINGLE
CONSOLIDATED COUNTY/CITYWIDE 311 CALL ANSWER CENTER THAT WILL
PROVIDE CITIZENS WITH A SIMPLIFIED WAY TO ACCESS COUNTY AND CITY
INFORMATION AND SERVICES; RESCINDING, IN ITS ENTIRETY, RESOLUTION
NO. 03-1125, ADOPTED DECEMBER 18, 2003, WHICH APPROVED AN EARLIER
VERSION OF THIS AGREEMENT.
WHEREAS, Resolution No. 03-1225, adopted December 18, 2003, authorized the City Manager
to execute an Inter -Local Agreement ("Agreement") with Miami -Dade County ("County"), to implement
a single consolidated Countywide 311 Call Center to provide citizens with a simplified way to access
County and City of Miami ("City") information and services; and
WHEREAS, a change in County Administration among other factors caused the County not to
accept the earlier version of the Agreement and the parties have now negotiated a new Agreement
for these purposes; and
WHEREAS, the major changes in the new Agreement is that the Agreement is no longer a legally
enforceable contract but a simple agreement between two parties with no remedies provided for
failure to meet performance commitments, and it includes the additional County commitment
requested by the City Manager that the City residents/departments receive the same level of service
from the 311 Call Answer Center that the County residents/departments receive; and
WHEREAS, the Agreement also retained the Florida Governmental Conflict Resolution Act
procedures which provide for certain joint public meetings between the parties to attempt to resolve
their dispute before any civil suit is maintained; and
WHEREAS, funding for said services for the 311 Call Answer Center is in the amount of
$423,737, allocated from the Federal Community Policing Services Program; and
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an Interlocal Agreement, consisting of a
non -binding Agreement, in substantially the attached form, with the County to implement a single
consolidated County/Citywide 311 Call Answer Center that will provide citizens with a simplified way to
access County and City information and services.

Section 3. Resolution No. 03-1225, adopted on December 18, 2003, which approved an earlier
version of this Agreement, is rescinded in its entirety.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of 10 calendar
days from the date it was passed and adopted. If the Mayor vetoes this resolution, it shall become
effective immediately upon override of the veto by the City Commission.
