BACKGROUND; The Florida Department of Transportation (FDOT) is completing plans for the reconstruction of N.W./N.E. 36 Street between N.W. 7 Avenue and N.E. 7 Avenue. The majority of the project between N.W. 7 Avenue and Biscayne Boulevard is located within right-of-way under the jurisdiction of the State of Florida. However, the portion of N.E. 36 Street between Biscayne Boulevard and N.E. 7 Avenue (the beginning of the entrance ramp to the Julia Tuttle Causeway) is under the jurisdiction of the City of Miami. Since this portion of N.E. 36 Street serves as a critical connection between Biscayne Boulevard, the exit ramp from I-95 and the Julia Tuttle Causeway, it is essential that this section be included in the current FDOT project and that the FDOT retains maintenance responsibility for this Urban Minor Arterial roadway. The FDOT construction plans for the roadway have been designed sensitive to the access needs and concerns of the adjacent property owners including the existing and proposed condominium developments. In order for FDOT to complete its plans, it is necessary that the right-of-way for N.E. 36 Street between Biscayne Boulevard and N.E. 7 Avenue be transferred to the jurisdiction of the State Highway System so that the FDOT may assume reconstruction responsibility for N.E. 36 Street and the maintenance responsibility for the roadway. The Honorable Mayor and Members of the City Commission Page 2 The FDOT has prepared the necessary right of way map for the subject area to be transferred and will be responsible for all costs to construct the improvements. This Resolution permits the proper recording of the required right-of-way map to effect the transfer of jurisdiction and reclassification of the roadw to its proper Urban Minor Arterial status.
