A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR -FIFTHS (4/5)
AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, AUTHORIZING THE ACQUISITION
OF SERVICES FROM SUNSHINE MEDICAL CENTER, FOR THE PROVISION OF
PHYSICAL EXAMINATION SERVICES ON ATEMPORARY MONTHLY BASIS, FOR
THE DEPARTMENT OF EMPLOYEE RELATIONS, IN AN AMOUNT NOT TO
EXCEED $50,000, UNTIL SUCH TIME THE CITY COMMISSION APPROVES THE
CITY MANAGER'S RECOMMENDATION TO AWARD, NEGOTIATE AND EXECUTE,
PROFESSIONAL SERVICES AGREEMENTS WITH THE SUCCESSFUL
PROPOSER(S), WHOSE PROPOSAL IS DETERMINED TO BE THE MOST
ADVANTAGEOUS TO THE CITY OF MIAMI ("MIAMI") IN RESPONSE TO REQUEST
FOR PROPOSALS ("RFPS") NOS. 03-04-079, 03-04-080, AND 03-04-081;
ALLOCATING FUNDS FROM THE DEPARTMENT OF EMPLOYEE RELATIONS'
GENERAL OPERATING BUDGET ACCOUNT CODE NO. 001000.270101.6.260;
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
PURPOSE.
WHEREAS, the contract for physical examination services expired on August 31, 2003; and
WHEREAS, Request For Proposals ("RFP") No. 02-03-095 was issued on April 21, 2003, for the
provision of physical examination services, and only one proposer was deemed responsive, and on
July 28, 2003 the City Manager rejected the RFP process in an effort to seek greater vendor
participation; and
WHEREAS, to continue to provide physical examination services, a purchase order in the amount
of $15,000, was issued to Sunshine Medical Center on August 22, 2003; and
WHEREAS, the specifications were re -defined and modified, in an effort to facilitate more of a
competitive pool and attract more small and local service providers, three separate RFPs were issued
for physical examination services on March 18, 2004; and
WHEREAS, the Department of Employee Relations is in the process of establishing the
evaluation committees to evaluate the responses, and anticipate bringing this item to the City
Commission for award of the contracts to the most responsive vendor by July 2004; and
WHEREAS, Sunshine Medical Center will provide physical examination services on a temporary
monthly basis to the City of Miami ("City") until such time the City Commission approves the City
Manager's recommendation to award, negotiate and execute professional services agreements with
the successful proposer(s) whose proposal is determined to be the most advantageous to the City in
response to Request for Proposals (Nos. 03-04-079, 03-04-080, and 03-04-081); and

WHEREAS, funding is available in an amount not to exceed $50,000 for the provision of physical
examination services, from the General Operating Budget of the Department of Employee Relations,
Account No. 001000.270101.6.260;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager's finding of an emergency
authorizing the acquisition of services from Sunshine Medical Center for the provision of physical
examination services on a temporary monthly basis for the Department of Employee Relations, is
ratified, approved and confirmed, in an amount not to exceed $50,000, until such time the City
Commission approves the City Manager's recommendation to award, negotiate and execute
professional services agreements with the successful proposer(s) whose proposal is determined to be
the most advantageous to the City of Miami, in response to RFP Nos. 03-04-079, 03-04-80, and 03-
04-081, with funds allocated from the Department of Employee Relations' General Operating Budget
Account Code No. 001000.270101.6.260.
Section 3. The City Manager is authorized{1} to execute all necessary documents, in a form
acceptable to the City Attorney.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
