HomeMy WebLinkAboutR-04-0305City of Miami Legislation Resolution: R-04-0305 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00489a Final Action Date: 5/6/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION ESTABLISHING A SELECTION ADVISORY COMMITTEE TO REVIEW AND RECOMMEND CANDIDATES FOR THE POSITION OF CITY ATTORNEY AND TO INCLUDE PERSONAL INTERVIEWS OF THE APPLICANTS AS DETERMINED BY THE COMMITTEE; DESIGNATING THE CHAIRPERSON THEREOF; FURTHER REQUESTING SAID COMMITTEE TO: (A) ADVERTISE THE POSITION OF CITY ATTORNEY FOR THE CITY OF MIAMI FOR 45 DAYS; (B) FOLLOW CERTAIN CRITERIA IN ITS CONSIDERATION; (C) RECOMMEND NO LESS THAN THREE AND NO MORE THAN FIVE APPLICANTS FOR SAID POSITION; AND (D) CONCLUDE ITS PROCESS, IF POSSIBLE, FOR ACTION OF THE CITY COMMISSION, BY JULY 22, 2004. WHEREAS, the position of City Attorney will become vacant and it is now in order for the City Commission to appoint a new permanent City Attorney; and WHEREAS, the City Commission desires to create and establish the City Attorney Selection Committee; and WHEREAS, the City Commission will make its appointment of the City Attorney from a list of applicants selected by said Committee; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A six (6) member Selection Advisory Committee ("Committee") is established to advertise the position of City Attorney for the City of Miami for 45 days, and conduct a review of applications for the position of City Attorney including personal interviews of the applicants. Said applications will be received by the Office of the City Clerk and Joel E. Maxwell will serve as Special Counsel to the Office of the City Clerk for said purpose. The Committee shall establish its own rules and guidelines; however, the Committee is requested to consider, as a minimum, the following criteria and qualifications: (a) Practicing in Florida with a minimum of five years experience. (b) Experience in the practice of municipal law or experience in representing federal, local or state governments. (c) Administrative or supervisory experience within a bureaucratic structure. (d) Wide range of civil practice with due significance being given to certified specialists in City of Miami Page 1 of 2 File Id: 04-00489a (Version: 1) Printed On: 9/12/2016 File Number: 04-00489a Enactment Number: R-04-0305 local government law as designated by the Florida Bar and expertise in matters dealing with torts, land use, contracts and labor law. (e) Demonstrated sensitivity to social process including the area of international law and issues of affirmative action and civil rights; personal integrity, ethics and reputation for good character generally and in the legal community. Section 3. The Committee is further requested to recommend no less than three and no more than five applicants for said position to the City Commission for consideration at its regular meeting on July 22, 2004. Section 4. The Committee shall be composed of the following members: (a) Arthur E. Teele, Jr., the Chair of the Miami City Commission, representing City of Miami Commission District 5, shall serve as the Chairperson of the Selection Advisory Committee. (b) The present City Attorney, Alejandro Vilarello, shall serve as the Vice -Chair of the Selection Advisory Committee. (c) Four (4) members of the Florida Bar, appointed by the City Commissioners representing Districts City of Miami Commission Districts 1 through 4. Said appointments will be made in writing and transmitted to the Office of the City Clerk. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
