SUBJECT: Resolution granting Perpetual
Non-exclusive Easement
to FDOT

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing the City Manager to execute a Grant of Perpetual Non-exclusive Easement
("Easement"), in substantially the attached form, with the State of Florida Department of
Transportation ("FDOT") for the use of a City -owned strip of land 15 feet wide located adjacent
to Biscayne Boulevard between N.E. 8th Street and 9th Street, Miami, Florida, as more
particularly described in Exhibit "A" attached hereto and made a part hereof (the "Property"), for
the sole purpose of constructing and maintaining a drainage system; with the terms and
conditions as more particularly set forth in said Easement.
BACKGROUND:
FDOT proposes to construct or improve State Road No. 5 (US-1), Item/Segment No. 2498352, in
Miami -Dade County, Florida. The City of Miami is the owner of a strip of land 15 feet wide,
lying adjacent to Biscayne Boulevard between N.E. 8th Street and 9th Street, Miami, Florida,
(the "Property"), as more particularly described in Exhibit "A" which is attached hereto and
made a part hereof.
FDOT is requesting the right and the privilege to use a non-exclusive Perpetual Easement with
full rights of ingress thereto and egress on the Property, to construct and maintain a drainage
system. In the event this easement is disconnected or abandoned, the easement will cease and
revert to the City. The Department of Public Works has reviewed this item and has no objections
to this request.
Financial Ipact: There is no negative financial impact to the City.
