Case No. 2004-0779
Pursuant to Article 4, Sections of Ordinance 11000, as amended, the Zoning Ordinance
of the City of Miami, Florida, the subject proposal has been reviewed for a Variance to
allow a front yard setback as follows:
Required Front Yard - 20' - 0"
Proposed Front Yard - 5' - 0"
Request to waive —15 '-0"
The following findings have been made:
• It is found that the subject property is of such a particular size and configuration that
does constitute a hardship pursuant to Zoning Ordinance 11000; the subject lot
current requirements as it stands, will not allow for any reasonable development.
• It is found that a literal interpretation of the provisions of the Zoning Ordinance
would deprive the applicant of the rights commonly enjoyed by other properties
within the same zoning district.
• It is found that the grant of this variance is in harmony with the general intent and
purpose of the Zoning Ordinance and is not injurious to the neighborhood.
Based on these findings, the Planning and Zoning Department is recommending
approval of the requested front yard setback variance for the proposed structure on
the subject property.
