HomeMy WebLinkAboutO-12520City of Miami Legislation Ordinance: 12520 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00336 Final Action Date: 4/8/2004 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE XI/DIVISION 3 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS/MAYOR'S INTERNATIONAL COUNCIL," TO CHANGE THE VOTING STATUS OF THE MAYOR FROM A VOTING TO NON -VOTING MEMBER, TO CHANGE THE STATUS OF THE EXECUTIVE DIRECTOR, TO ADD TWO MEMBERS TO THE BOARD TO BE APPOINTED BY THE COMMISSION -AT -LARGE AND TO CORRECT AN ERROR IN THE TERMS OF THE MEMBERS APPOINTED BY THE COMMISSION TO BE APPOINTED FOR SPECIFIC STAGGERED EXPIRATION TERMS; MORE PARTICULARLY BY AMENDING SECTION 2-923(a) OF SAID CODE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 2/Article XI/Division 3 of the Code of the City of Miami, Florida, as amended, is amended in the following particulars :{1} "Chapter 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS DIVISION 3. MAYOR'S INTERNATIONAL COUNCIL * Sec. 2-923. Governing body: composition and appointments; terms of office and vacancies; membership eligibility requirements; oath; quorum and voting; meetings; attendance requirements; parliamentary authority and rules of procedure; and indemnification. (a) Composition and appointments, term of office. The Council shall consist of sixteen (16) members (fifteen voting members and one non -voting ex-officio member) who shall serve as set forth herein. All members, cept for the Executive Director, shall serve without compensation, but shall be reimbursed for necessary expenses incurred in official duties. The Governing Body shall consist of: 1. the Mayor who shall be an ex-officio, non -voting member and serve in accordance with the provisions of Section 2-35 of this Code or until the Mayor City of Miami Page 1 of 2 File Id: 04-00336 (Version: 11 Printed On: 9/6/2016 File Number: 04-00336 Enactment Number: 12520 leaves office; and 2. a City Commissioner appointed by the City Commission who shall be Vice -Chairperson of the Council and shall serve in accordance with the provisions of Section 2-35 of this Code or until the Commissioner leaves office; and 3. eight seven individuals appointed by the Mayor who shall serve for a term of one year or until the Mayor leaves office, whichever occurs first; and 4. five seven individuals appointed by the City Commission who shall serve for a term of four years, staggered with three four individuals being whose terms expire appointed in 2003 2005 and two three individuals being appointed in 2005 2006; and 5 the Executive Director of the Council who shall be a non voting ex officio member and serve for the duration of his appointment as Executive Director of the Council." Section 2. All ordinances or parts of ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
