HomeMy WebLinkAboutO-12519City of Miami Legislation Ordinance: 12519 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00299 Final Action Date: 4/8/2004 AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING CHAPTER 2, ARTICLE XI, DIVISION 2, SECTION 2-887(b) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "QUORUM REQUIREMENTS; EXCEPTIONS" TO EXEMPT THE DOWNTOWN DEVELOPMENT AUTHORITY ("DDA") FROM THE QUORUM REQUIREMENTS SET FORTH THEREIN; AND AMENDING CHAPTER 14, ARTICLE II, DIVISION 2, SECTION 14-52 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "MEETINGS; RULES AND REGULATIONS; COMPENSATION OF MEMBERS" TO ESTABLISH THE QUORUM REQUIREMENTS OF THE DDA; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 2-887 of the Code of the City of Miami provides the quorum requirements applicable to all boards' meetings, except the boards listed under Section 2-887(b); and WHEREAS, pursuant to the above mentioned section, the quorum for the meetings of the Board of Directors of the Downtown Development Authority ("DDA") is fifty percent (50%) plus one of the board's total membership; and WHEREAS, the Board of Directors of the DDA adopted Resolution No. 47/03 on September 19, 2003, requesting the Miami City Commission to make the necessary amendments to the Code of the City of Miami, Florida, to reduce the quorum requirements for the DDA from fifty percent (50%) plus one to five (5) Board members; and NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Recitals and findings contained in the preamble to this Ordinance are adopted by reference and are incorporated as if fully set forth in this Section. Section 2. Chapter 2, Article XI, Division 2, Section 2-887(b) of the Code of the City of Miami, Florida, as amended, entitled "Quorum requirements; exceptions" is amended to read as follows:{1} "CHAPTER 2 ADMINISTRATION ARTICLE XI. Quorum requirements; exceptions. * (b) The following boards are subject to quorum requirements as provided for elsewhere in this code. Bayfront Park Management Trust Brownfields Advisory Board Coconut Grove Special Events and Marketing Committee Downtown Development Authority Equal Opportunity Advisory Board International Trade Board Miami commission on the Status of Women Parking Advisory Board Street Codesignation Review Committee Urban Development Review Board *11 Section 3. Chapter 14, Article II, Division 2, Section 14-52 of the Code of the City of Miami, Florida, as amended, entitled "Downtown Development Authority Board -Composition; appointment and terms of office of members and executive board; filling of vacancies" is amended in the following particulars:{1} "CHAPTER 14 DOWNTOWN DEVELOPMENT * ARTICLE II. DOWNTOWN DISTRICT Division 2. Downtown Development Authority * Sec. 14-52. "Downtown Development Authority board -Composition; appointment and terms of office of members and executive board; filling of vacancies; quorum requirements." * (e)Quorum shall consist of five (5) members. Rules of procedure of the board may require up to nine (9) members to be present in person or by telephone to take board action. *11 Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.{2} Footnotes: {1} Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
