Ferna City Attorney November 14, 2005 Corrected Scrivener's Error Resolution No. R-04-0240, adopted April 8, 2004. Legistar File No. 03-0422 Resolution No. R-04-0240, adopted April 8, 2004, contains a scrivener's error as the executed Resolution does not accurately reflect the action of the City Commission. The minutes of the City Commission meeting of April 8, 2004, reflect that Commissioner Sanchez made a motion to adopt a resolution closing, vacating, abandoning and discontinuing for public use a portion of the right-of-way located on approximately Southwest 2" Court between southwest 17th Road and Interstate I-95. The motion was seconded by Commissioner Gonzalez. The motion passed and the resolution was adopted by a vote of four to one 4-1. Unfortunately, the legislation found in Legistar under file number 03-0422 reflects that the opposite occurred and that the City Commission denied the street closure. The property owner is trying to move forward with his development and is unable to proceed due to the scrivener's error. The title of the Resolution was properly advertised and proper notice to adjacent property owners was provided. Therefore, the document found in Legistar has been corrected by creating a new version 2 of the resolution. The new version 2 accurately reflects the closure of the section of the public right-of-way. Please take whatever additional steps are necessary to update the Legistar system to reflect the action taken by the City Commission on April 8, 2004. This memorandum should be attached to Resolution No. R-04-0240, so that any concern regarding the substitution of said Resolution is clarified. JLF:GKW Attachments C: Maria J.
