HomeMy WebLinkAboutPZ AnalysisPLANNING AND ZONING DEPARTMENT ANALYSI S Case No. 2003-0726 VACATION AND CLOSURE OF A PORTION OF SW 2nd COURT BETWEEN EAST OF 1-95 AND WEST OF 17th ROAD RIGHT-OF-WAY Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department has reviewed the proposed street vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right- of-way. The following findings have been made: • It is found that this street closure was initially reviewed by the Internal Design Review Committee on April 22, 2003 as part of the Century Tower Project and recommended against the street closure. • It is found that the vacation of the street could have unanticipated long term consequences and could ultimately facilitate the development of a building that is inconsistent with the height, bulk, scale and character of existing buildings south of Roads area. • It is found that the property owner has failed to demonstrate any public benefits that would be provided as a result of the proposed street vacation. Based on these findings, the Planning and Zoning Department recommends denial of the request.
