HomeMy WebLinkAboutR-04-0236City of Miami Legislation Resolution: R-04-0236 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00317 Final Action Date: 4/8/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE ALLOCATION OF COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") PROGRAM FUNDS, IN AN AMOUNT NOT TO EXCEED $90,000, FROM PREVIOUSLY APPROVED DISTRICT 5 LITTLE HAITI JOB CREATION PILOT PROJECT SET -ASIDE TO TARPUN BAY USA, INC., IN THE FORM OF A FIVE-YEAR DEFERRED, FORGIVABLE LOAN WITH THE PROVISION THAT THE FUNDS BE USED TO CREATE AND MAINTAIN NEW EMPLOYMENT OPPORTUNITIES FOR RESIDENTS OF THE LITTLE HAITI NEIGHBORHOOD, FORA FIVE-YEAR PERIOD, SUBJECT TO PROVISIONS STATED HEREIN; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM WITH SAID AGENCY. WHEREAS, Resolution No. 98-402.1, adopted April 14, 1998, authorized the allocation of Community Development Block Grant ("CDBG") Program funds, in the amount of $225,000, to implement the Little Haiti Job Creation Project ("Project"), which represented the first installment of a five-year commitment to create jobs and stimulate businesses in the Edison Little River area; and WHEREAS, Resolution No. 01-443, adopted on May 10, 2001, the City Commission approved the creation of the District 5 Pilot Project and adopted project guidelines; and WHEREAS, on March 4, 2004, the District 5 Pilot Project Advisory Board reviewed and voted to recommend the allocation of CDBG Program funds, in an amount not to exceed $90,000, to Tarpun Bay USA, Inc. for the creation and maintenance of new employment opportunities for residents of the Little Haiti neighborhood for a five-year period; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of Community Development Block Grant funds set aside for the District 5 Little Haiti Job Creation Pilot Project, for the creation and maintenance of new employment opportunities for residents of the Little Haiti neighborhood for a five-year period, in the form of a five-year deferred, forgivable loan, subject to the following provisions: (i) applicant providing evidence of available financing to complete the project, (ii) project receiving United States Department of Housing and Urban Development approved environmental clearance, and (iii) project meeting all applicable local, State and Federal regulations, is authorized, in the following particulars: City of Miami Page 1 of 2 File Id: 04-00317 (Version: 11 Printed On: 9/7/2016 File Number: 04-00317 Enactment Number: R-04-0236 Agency Tarpun Bay USA, Inc. Amount New Jobs $ 90,000 6 Section 3. The City Manager is authorized{1} to enter into an Agreement with said agency for said purpose, in substantially the attached form, subject to applicable City Code provisions. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor{2}. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
