HomeMy WebLinkAboutCover MemoCITY OF MIAMI, FLORIDA ov3A INTER -OFFICE MEMORANDUM TO : FROM : The Honorable aybr and Membe of ity Co Joe • ola Chie • dministrator/ City Manager DATE : FILE : MAR 17 2004 SUBJECT: Resolution Granting Easement to Florida Power and Light REFERENCES : Commission Agenda ENCLOSURES: April 8, 2004 RECOMMENDATION: The administration recommends that the City Commission adopt the attached Resolution authorizing the City Manager to execute a Grant of Easement on City -owned property located at approximately 2640 South Bayshore Drive, Miami, Florida, in substantially the attached form, to Florida Power and Light Company, of a ten (10) to fourteen (14) foot wide strip utility easement, as more particularly described in Exhibit "A" attached hereto and made a part hereof, for a perpetual, non-exclusive easement on the property, for the construction, operation and maintenance of underground electric utility facilities and vault, with the right to reconstruct, improve, change the voltage, and remove such facilities or any of them within the easement. BACKGROUND: Florida Power and Light Company has requested a ten (10) to fourteen (14) foot wide strip utility easement on City -owned property for the construction, operation and maintenance of underground electric utility facilities and vault to be installed in connection with the development of Grove Harbour Marina and Caribbean Marketplace. This easement will include the right to reconstruct, improve, change the voltage, and remove such facilities or any of them within the easement, with full right of ingress thereto and egress therefrom. The easement shall further contain a reverter provision that if the easement is abandoned or discontinued, the easement shall cease and revert back to the City. Financial Impact: There is no impact to the general fund of the City since Grove Harbour Marina is responsible for any expenses associated with the construction of this easement. 7A: H::PK:eb:m FPL easement Grove Harbour
