A RESOLUTION OF THE MIAMI CITY COMMISSION AMENDING RESOLUTION
NO. 03-1243, ADOPTED DECEMBER 18, 2003, WHICH DIRECTED THE CITY
MANAGER TO PROCEED WITH ALL ACTIONS NECESSARY TO FORMALLY
VACATE THE ALLEYWAY BEHIND THE LYRIC THEATER, LOCATED AT 819
NORTHWEST 2ND AVENUE, MIAMI, FLORIDA, TO INCLUDE THE STREET
VACATION OF NORTHWEST 1ST COURT FROM NORTHWEST 9TH STREET TO
NORTHWEST 8TH STREET, MIAMI, FLORIDA; AUTHORIZING THE CITY
MANAGER TO WAIVE ALL HEARING BOARD FEES.
WHEREAS, the Black Archives, History and Research Foundation of South Florida, Inc.
("Black Archives"), has embarked on an extensive project to expand the historic Lyric Theater
("Project"); and
WHEREAS, the Community Redevelopment Agency ("CRA") adopted Motion M-02-155,
directing the CRA Executive Director to request the City of Miami, specifically the Department of
Public Works, to initiate and complete all necessary steps to formally vacate said alleyway; and
WHEREAS, Resolution No. 03-1243, adopted December 18, 2003, to complete one
component of the Project, by vacating and replatting a 10-foot alleyway located just east of the
Project; and
WHEREAS, vacation of Northwest 1st Court is necessary to fully complete the initial action
requested by Resolution No. 03-1243 and would avoid remnant parcels;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. Resolution No. 03-1243, adopted on December 18, 2003, which directed the City
Manager to proceed with all actions necessary to formally vacate the alleyway behind the Lyric
Theater located at 819 Northwest 2nd Avenue, Miami, Florida, is amended in the following
particulars:{1 }

Section 3. The City Manager is directed{1} to expeditiously proceed with all
actions necessary to formally vacate the alleyway behind the property located at

819 Northwest 2nd Avenue, Miami, Florida, including Northwest 1st Court from
Northwest 9th Street to Northwest 8th Street, and to carry forth all actions
necessary to transfer said property to the Black Archives pursuant to the CRA's
intent, subject to a final decision by the City Commission.
Section 3. The City Manager is authorized{2} to waive all hearing board fees.
Section 4. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{3}

{2} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City

{3} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
