HomeMy WebLinkAboutpre. legislationCity of Miami Legislation Resolution: R-03-1243 City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 03-0326 Final Action Date: 12/18/2003 A RESOLUTION OF THE MIAMI CITY COMMISSION, ACCEPTING AND RATIFYING THE CRA BOARD'S ACTIONS RELATIVE TO THE HISTORIC LYRIC THEATER AND DIRECTING THE CITY MANAGER TO EXPEDITIOUSLY PROCEED WITH ALL ACTIONS NECESSARY TO FORMALLY VACATE THE ALLEYWAY BEHIND THE LYRIC THEATER, LOCATED AT 819 NORTHWEST 2ND AVENUE, MIAMI, FLORIDA, AND TO CARRY FORTH ALL ACTIONS NECESSARY TO TRANSFER SAID PROPERTY TO THE BLACK ARCHIVES PURSUANT TO SAID CRA INTENT, PENDING A FINAL DECISION BY THE CITY COMMISSION. WHEREAS, the Black Archives, History and Research Foundation of South Florida, Inc. ("Black Archives"), has embarked on an extensive project to expand the historic Lyric Theater ("Project"); and WHEREAS, it has been determined that one component of the Project would necessitate vacating and replatting a 10-foot alleyway located just east of the Project; and WHEREAS, the Community Redevelopment Agency ("CRA") adopted Motion M-02-155, directing the CRA Executive Director to request the City of Miami, specifically the Department of Public Works, to initiate and complete all necessary steps to formally vacate said alleyway, pending a final decision by the City Commission; and WHEREAS, the CRA also authorized the Executive Director to work with the City's Public Works Department, Planning Department and consultant engineers to facilitate the requisite survey and platting process associated with the vacating and conveyance of the subject alleyway; and WHEREAS, an inordinate period of time has elapsed without meaningful action by the Public Works Department on the subject alley vacation and replatting; and WHEREAS, the City Commission seeks to ensure that all preliminary actions precedent to a final City Commission decision on any replatting of the subject alleyway are immediately completed by the Administration; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1.The recitals and findings contained in the Preamble to this Resolution are City of Miami Pagel of 2 Printed On: 4/2/2004 File Number: 03-0326 Enactment Number: R-03-1243 adopted by reference and incorporated as if fully set forth in this Section. Section 2,The City Commission accepts and ratifies the CRA Board's action relative to the subject historic Lyric Theater alley vacation. Section 3.The City Manager is directed{1} to expeditiously proceed with all actions necessary to formally vacate the alleyway behind the property located at 819 Northwest 2nd Avenue, Miami, Florida, and to carry forth all actions necessary to transfer said property to the Black Archives pursuant to the CRA's intent, subject to a final decision by the City Commission. Section 4.This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes; {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
