AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AUTHORIZING
THE CITY MANAGER TO ACCEPT AN INCREASE IN GRANT AWARD FUNDING, IN
THE AMOUNT OF $30,365.78, FROM THE COMMEMORATIVE ASSOCIATION FOR
THE JAPAN WORLD EXPOSITION OF 1970, FOR THE RECONSTRUCTION OF
THE ICHIMURA MIAMI-JAPAN GARDEN ON WATSON ISLAND; APPROPRIATING
SAID FUNDS INTO CAPITAL IMPROVEMENTS PROJECT ACCOUNT NO. 331417,
ENTITLED ICHIMURA MIAMI JAPANESE GARDEN.
WHEREAS, on September 25, 2001, the City of Miami ("City") submitted a proposal to the
Consulate General of Japan in Miami requesting that an application for funding from the Japan World
Exposition Commemorative Fund be submitted to the Commemorative Association for the Japan
World Exposition of 1970 requesting ¥94,751,020 ($790,000) to redesign and construct the lchimura
Miami -Japan Garden on Watson Island; and
WHEREAS, an award letter dated June 13, 2002, noted that the City was the only United
States applicant to receive funding from the Commemorative Association for the Japan World
Exposition of 1970 and was awarded V20,000,000 ($154,000, 2002 value); and
WHEREAS, the value of this award has increased by $30,365.78 from $154,000 to
$184,365.78 due to the fluctuation in the value of the Japanese Yen; and
WHEREAS, on March 19, 2004, the Commemorative Association for the Japan World
Exposition of 1970 wire transferred funds in the amount of ¥20,000,000 ($184,365.78, 2004 value) to
the City; and
WHEREAS, construction is in progress at the lchimura Miami -Japan Garden and these funds
are needed for immediate expenditure; and
WHEREAS, it is in the best interest of the City to accept an increase in grant award funding
from the Commemorative Association for the Japan World Exposition of 1970 for the reconstruction of
the lchimura Miami -Japan Garden on Watson Island;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to accept an increase in funding from the
Commemorative Association for the Japan World Exposition of 1970, in the amount of $30,365.78,
for the redesign and construction of the lchimura Miami -Japan Garden on Watson Island.

Section 3. The City Manager is authorized{1} to appropriate said funds into Capital
Improvements Project Account No. 331417, entitled Ichimura Miami -Japanese Garden.
Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict
with the provisions of this Ordinance are repealed.
Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is declared to be an emergency measure on the grounds of urgent
public need for the preservation of peace, health, safety, and property of the City of Miami, and
upon further grounds of the necessity to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and required purchases of goods and
supplies and to generally carry on the functions and duties of municipal affairs.
Section 7. The requirement of reading this Ordinance on two separate days is dispensed with
by an affirmative vote of not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective immediately upon its adoption and signature
of the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within
ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.
