RE: Attached Ordinances rommendation for second reading adoption concerning
amendments to Code p visions to provide for parades, assemblies and processions in
parks and on public right of ways.
The City Commission adopted, on first reading, revisions to sections of the Code of the
City of Miami that may impact demonstrations and other events where First Amendment principles
apply. The changes in Chapter 54, {File Number 04-00212}, relate to use and permits for public
right of ways and the changes in Chapter 38, {File Number 04-00213}, relate to use and permits for
city parks.
After first reading, an advertised meeting seeking public input regarding the changes
proposed was held at 5:00 PM at City Hall on March 16, 2004. In addition to the advertisement,
representatives of various interested groups were notified of the time and location of the meeting. A
representative from the ACLU was present along with department representatives. After taking
input and after discussion, some minor language adjustments and changes were made. I recommend
that the ordinances be adopted at second reading as attached.
