HomeMy WebLinkAboutLegislation ACity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 03-0380 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, REVERSING THE DECISION OF THE ZONING BOARD, GRANTING THE APPEAL BY THE TOWER RESIDENCES CONDO ASSOCIATION, JEFF STEWART AND RESIDENTS OF THE RITZ CARLTON CONDOMINIUM, AND DENYING CLASS II SPECIAL PERMIT APPLICATION NO. 03-0009 ISSUED BY THE PLANNING AND ZONING DIRECTOR ON SEPTEMBER 11, 2003, TO ALLOW CONSTRUCTION OF A TOWER AT THE GRAND BAY HOTEL FOR THE PROPERTY LOCATED AT APPROXIMATELY 2675 SOUTH BAYSHORE DRIVE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN ATTACHED "EXHIBIT A." WHEREAS, the Miami Zoning Board at its meeting of November 03, 2003, Item No. 5, adopted Resolution No. ZB 2003-0777 by a vote of six to zero (6-0), to affirm the decision issued on Class II Special Permit Application No. 03?0009 by the Planning and Zoning Director on September 11, 2003, and WHEREAS, an appeal of the Zoning Board decision was filed by the Tower Residences Condo Association, Jeff Stewart and residents of the Ritz Carlton Condominium; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the recommendation of the Zoning Board, finds the Class II Special Permit does not meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant the appeal, reverse the decision of the Zoning Board and Planning and Zoning Director and deny the Class II Special Permit as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2_ The decision of the Zoning Board to deny the appeal by the Tower Residences Condo Association, Jeff Stewart and residents of the Ritz Carlton Condominium, of the Class II Special Permit application no. 03-0009 issued by the Planning and Zoning Director on September 11, 2003, to allow new construction of a tower at the Grand Bay Hotel for the property located at approximately 2675 South Bayshore Drive, Miami, Florida, as legally described in attached "Exhibit A," is reversed and the Class II Special Permit is denied. The appeal is granted. Section 3.
