MAR T 5 2004 FILE Resolution Granting Easement to Florida Power & Light Company — Jose Marti Park Recreation Center City Commission Agenda March 25, 2004 RECOMMENDATION: The administration recommends that the City Commission adopt the attached Resolution, in substantially the attached form, for a Grant of Easement to Florida Power & Light Company ("FPL"), on City -owned property in Jose Marti Park, known as the Jose Marti Park Recreation Center, located at 362 Southwest 4th Street, Miami, Florida, as more particularly described in Exhibit."A", attached hereto and made a part hereof, for the installation, operation and maintenance of a new pad mounted transformer, with the right to install., improve, add to, enlarge, change the voltage, as well as, the size of and remove such. facilities or any of them within the easement. This Resolution further authorizes the City Manager to execute a Grant of Easement to FPL, for said purpose, BACKGROUND: The City of Miami ("City") has constructed a new recreation facility in Jose Marti Park and has requested that FPL provide electrical service to the new facility. However, FPL `s tran.sforrncr is currently located on private property, and FPL needs access to the facility in order to provide electrical service to the facility. FPL has provided the City temporary power until a new transformer can be insta.11ed on City -owned property to provide service to the facility. FPL is charging the City $4,993.00 to install a new ground mount service transformer to provide permanent electric power to the facility, and has requested that they be granted a 48 square foot easement from the City. FPL shall, at its sole cost and expense, maintain the new pad mounted transformer with the right to improve, change the voltage, and remove such facilities or an.y of them within the easement, with full right of ingress thereto and egress therefrom. in the event this easement is disconnected. or abandoned, the easement will cease and revert to the City.
