MAC; 11 2004 FILE : Resolution Granting Easement to Florida Power & Light Company — Property adjacent to Jose Marti Park City Commission Agenda March 25, 2004 RECOMMENDATION: The administration recommends that the City Commission adopt the attached Resolution, in substantially the attached form, for a Grant of Easement to Florida Power & Light Company ("FPL"), on City -owned property between Southwest 5th Street and Southwest hth Street adjacent to Jose Marti Park, Miami, Florida, as more particularly described in Exhibits "A", "B", "C", and "D" attached hereto and made a part hereof, for the construction, operation and maintenance of overhead and underground electric utility facilities, including the relocation of three (3) existing poles and the installation of a new manhole, with the right to reconstruct, improve, add to, enlarge, change the voltage, as well as, the size of and remove such facilities or any of them within the easement. This Resolution further authorizes the City Manager to execute a Grant of Easement to FPL, for said purpose. BACKGROUND: The United States Corps of Engineers ("COE") has requested that FPL relocate its subaqueous river crossings because they do not meet the new depth criteria under the Miami River Dredging Project. FPL has begun bore crossings under the Miami River at 1-95 but because of congestion of existing underground utilities within the right -of way along Southwest 3rd Avenue, it is impossible to locate its facilities within the right-of-way. FPL has requested that they be granted a 204.6 square foot easement from the City of Miami ("City") in order to relocate utility facilities in order to continue to provide and enhance electric power to City residents and the general public. FPL shall, at its sole cost and expense, construct, operate and maintain overhead and underground electric utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be installed from time to time; with the right to reconstruct, improve, change the voltage, and remove such facilities or any of them within the easement, with full right of ingress thereto and egress therefrom. In the event this easement is disconnected or abandoned, the easement will cease and revert to the City.
