HomeMy WebLinkAboutR-04-0183City of Miami Legislation Resolution: R-04-0183 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00089 Final Action Date: 3/25/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN INCREASE IN THE CONTRACT WITH MOTOROLA, INC., SOLE SOURCE PROVIDER, PURSUANT TO RESOLUTION NO. 02-1167, ADOPTED OCTOBER 29, 2002, FOR THE ACQUISITION OF EIGHTY (80) ADDITIONAL MOTOROLA XTS 5000 PORTABLE RADIOS WITH ACCESSORIES FOR THE DEPARTMENT OF FIRE -RESCUE, IN AN AMOUNT NOT TO EXCEED $279,256, INCREASING THE CONTRACT AMOUNT FOR THE SECOND YEAR FROM $334,974.60 TO $614,230.60, AND THE TOTAL CONTRACT AMOUNT FROM $845,846.10 TO $1,125,102.10; ALLOCATING FUNDS FROM THE FEDERAL GRANT ENTITLED, "URBAN AREAS SECURITY INITIATIVE ("UASI") GRANT PROGRAM II," PROJECT NO.110111, ACCOUNT CODE NO. 280910.6.840; AMENDING RESOLUTION NO. 02-1167, TO REFLECT SAID INCREASE. WHEREAS, Resolution No. 02-1167, adopted on October 29, 2002, authorized and approved the acquisition of Motorola XTS 5000 portable radios and Digital Spectra Consolettes base stations with Smartnet Type II software and accessories, and the provision to trade-in existing radios, for the Department of Fire -Rescue ("Fire -Rescue") from Motorola, Inc., sole -source provider, for an initial one-year term, at an estimated amount not to exceed $510,871.50, on an as -needed contract basis, with the option to renew for an additional one-year period, at an amount not to exceed $334,974.60, for the second contract year, for a total contract amount not to exceed $845,846.10; and WHEREAS, since the initial award, on July 17, 2003, the Miami City Commission adopted Ordinance No.12394, authorizing the purchase of specialized equipment, training, administrative services and development of the Urban Area Homeland Security Strategy, and other planning activities of the Federal Urban Areas Security Initiative ("UASI") Grant Program II (FY 2003); and WHEREAS, in accordance with the provision of the Federal UASI Grant Program II, Fire - Rescue requires an increase in the contract with Motorola Inc., for the acquisition of eighty (80) additional Motorola XTS 5000 portable radios and accessories to strengthen the City of Miami's ("City") level of readiness in compliance with the Federal UASI Grant Program II and the Weapons of Mass Destruction Preparedness Program; and WHEREAS, in an effort to improve public safety inter -operability the proposed telecommunications systems would allow Fire -Rescue to provide a radio for every firefighter for life safety purposes that allows effective, efficient, and reliable intra-agency and inter -agency communications; and WHEREAS, the XTS Motorola 5000 portable radios and accessories are compatible with City of Miami Page 1 of 3 File Id: 04-00089 (Version: 11 Printed On: 9/6/2016 File Number: 04-00089 Enactment Number: R-04-0183 federal, state, and local emergency response organizations to ensure inter -operability with other agencies; and . WHEREAS, said equipment is Motorola's APCO Project 25 digital solution approved by the Association of Public Safety Communications Officials ("APCO") and is consistent with and funded by the Federal UASI Grant Program II; and WHEREAS, the proposed amount for the acquisition of eighty (80) Motorola XTS 5000 portable radios and accessories is $279,256, increasing the second year contract amount from $334,974.60 to $614,230.60 and the total contract amount from $845,846.10 to $1,125,102.10; and WHEREAS, funds are available from the Federal UASI Grant Program II, Project No. 110111, Account Code No.280910.6.840; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An increase in the contract with Motorola, Inc., sole source provider, pursuant to Resolution No. 02-1167 , adopted October 29, 2002, in an amount not to exceed $279,256, for the acquisition of eighty (80) additional Motorola XTS 5000 portable radios with accessories for Fire -Rescue is authorized, with funds for said increase allocated from the Federal UASI Grant Program II, Project No. 110111, Account Code No.280910.6.840, amending Resolution No. 02- 1197 in the following particulars:{1} "Resolution No. 02-1197 Section 1. By a four -fifths (4/5ths) affirmative vote of the City Commission, after a duly advertised public hearing, the City Manager's finding of Sole Source is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the purchase of Motorola XTS 5000 portable radios and Digital Spectra Consolettes base stations with Smartnet Type II software and accessories and the provision to trade-in existing radios, for the Department of Fire -Rescue from Motorola, Inc., the sole source provider is approved, for an initial one-year term, at an estimated amount not to exceed $510,871.50, on an as -needed contract basis, with the option to renew for one additional year at an amount not to exceed $334,974.60 $614.230.60, for the second contract year, for a total contract amount not to exceed $845,846.10 $1,125,102.10, with funds allocated from Capital Improvement Project No. 289401.6.840, funded by the Fire Assessment. * * *,, City of Miami Page 2 of 3 File Id: 04-00089 (Version: 11 Printed On: 9/6/2016 File Number: 04-00089 Enactment Number: R-04-0183 Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
