HomeMy WebLinkAboutattorney memo-8G` e1r 5 Cso CITY OF MIAMI CITY ATTORNEY'S OFFICE MEMORANDUM TO: Mayor and Members of the City Commission FROM: Alejandro Vilarello, City Attorney — DATE: March 24, 2004 RE: March 11, 2004 Consent Agenda Item No.11., Healthcare Data Management (CA 11.-File No. 04-00200) At the March 11, 2004 City Commission meeting item CA.11, which was the item that asked for the acceptance of the City Manager's recommendation to approve the findings of the evaluation committee that a professional services agreement should be negotiated with Healthcare Data Management Inc.(HCDM), was discussed during the afternoon. The minutes of the meeting reflect that this item was adopted in the morning on the consent agenda with modifications. The item was discussed again in the afternoon, even though the item had been adopted. The modifications are not apparent from the record. HCDM was the top -ranked firm, and proposed to provide a comprehensive retrospective claims audit and other services for the Department of Risk Management, in an amount not to exceed $20,000, contingent upon completion of the current health care provider (CIGNA) audit, plus receipt of 35% of total recovered funds. After the afternoon discussion occurred, the item, in error, was deferred to the March 25, 2004 City Commission meeting. This item does not appear on the March 25, 2004 agenda because it had been adopted in the morning of March 11, 2004. In order for the City Commission to restate the modifications to this item , which we believe were to be made by adding an indemnification clause to the agreement and by changing an address in the agreement, it can be re -opened at the March 25, 2004 meeting.
