DATE: March 2, 2004 RE: ission Proposed Settlement-Ci r Commission Agenda -March 11, 2004 Mayko Acosta vs. of Miami, Christian Rios, Victor Palacios & Rafael Borroto, United States District Court, Case No.: 03-20444-CIV-UNGARO- BENAGES Claim No. 00757001514-PP-01 (File No. 04-00189) The attached proposed Resolution seeks authorization for the settlement of all claims against the City of Miami, its officers, agents, and employees, in the above referenced case, in the amount of $47,000. This is a federal civil rights lawsuit filed by a juvenile suspect, Mayko Acosta, who, at the time of the incident, was fleeing, and concealing himself, from the police. Mr. Acosta was ultimately apprehended by K-9. Mr. Acosta alleges the use of excessive force in his apprehension, and in his later treatment by the police.
