Unfortunately, we have lost the first battle in that the proposed project has passed First Reading. However, It has come to my attention that your organization was instrumental In stemming a similar developmental travesty in Coconut Grove, namely the "Commodore Plaza" project. Like the "Commodore Plaza" zoning matter, the Musa Isle City of Miami Nursery is up for Second Reading sometime in September, 1989 - the City has not informed the area residents of a date as yet. I beseach you to help us in this fight to save this bastion of Miami tranquility. The City of Miami has owned the subject property for years and it appears to me that the City has let the nursery get run down in anticipation of developing something in its stead. The property boasts of a bounty of adult oak trees, spanish moss, and unusual wildlife (a red fox among other creatures!). Please call us at your convenience. The phone numbers above are for both my home and work and I would like to get your counsel on how to fight City Hall in this matter as well as solicit your support if you deem it fitting. WHEREAS,'the Miami Planning Advisory Board, at its meeting of July 5, 1989, Item No. 4, following an addertised hearing adopted Resolution No. PAH 34-89, by a 7 to 1 vote, RECOMMENDING DENIAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, notwithstanding the Planning Advisory Hoard's recommendation, the City Commission after careful consideration of this matter d,eeins it advisable and in the ,best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI. FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification of approximately 2400 Northwest 14th Street, less the northern most two acres (approximately 340 feet by 250 feet), Miami, Florida. more particularly described as Tract 1, FERN ISLE REVISED, as recorded in Plat Book 35, at Page 77 of the Public Records of Dade County, Florida, from PR Parks and Recreation to RG-2/6 General Residential. 10644 ion change: conformity with this zoning, the adopted Miami . Comprehensive Neighborhood Plan: b. is not contrary to the established land use pattern; will not create an isolated district unrelated to adjacent and nearby districts; d. is not out of scale with the needs of the neighborhood or the City; e. will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; f. is necessary due to changed or changing conditions; g. will not adversely influence living conditions in the neighborhood; h. will not create or excessively increase traffic congestion or otherwise affect public safety; t. will not create a drainage problem; j. will not seriously reduce light and air to adjacent area; k. will not adversely affect property values in the adjacent area; 1. will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; and m. will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. Section 3. Page No. 25 of the Zoning Atlas, made a part of Ordinance No. 9500 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by this amendment. - 2- 10644 Section 4. All ordinances, code sections, or parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 5. Should any part or section, paragraph, clause, phrase or word of this Ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption hereof pursuant to law. PASSED ON FIRST READING BY TITLE ONLY this 31st July , 1989. day.
