CASE NO: 2003-0729 Pursuant to Article 4, Section 401 and Article 22 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for an amendment to the Zoning Atlas as follows: The request is to change the Zoning designation as follows: Lots 1, 2, 3, 4, 5 and 6 on Block 24, SOUTH BAY ESTATES SUBDIVISION (5 - 54), from R 2 "Two -Family Residential" to C-1 "Restricted Commercial". The following findings have been made: • It is found that the subject properties are currently under the same ownership of the immediately adjacent lots to the west, facing SW 27th Avenue, a major transportation corridor. • It is found that the frontage of the subject properties is on SW 27th Court, and that the character of this street is residential. • It is found that this petition is part of a Major Use Special Permit (MUSP) for a mix - use project named Tower Twenty-seven. • It is found that the Land Use designation for the subject properties is already Re- stricted Commercial, and this application, if granted, will bring into compliance the Land Use designation and the Zoning designation. • It is found that the theoretical potential commercial activities created by this amend- ment will not be an intrusion into the existing residential neighborhood due to the fact that the project includes town -houses on the subject properties with no vehicular traf- fic on 27th Court. Based on these findings, the Planning Department is recommending approval of the application as part of the Major Use Special Permit.
