HomeMy WebLinkAboutO-12487City of Miami Legislation Ordinance: 12487 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00120 Final Action Date: 2/26/2004 (4/5THS VOTE) AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12451, THE CAPITAL PROJECTS APPROPRIATIONS ORDINANCE, TO APPROPRIATE ADDITIONAL FUNDS, IN AN AMOUNT NOT TO EXCEED $1,870,000, CONSISTING OF AN AMOUNT NOT TO EXCEED $1,200,000 REPROGRAMMED FROM CAPITAL IMPROVEMENT PROJECT NO. 311613, AND AN AMOUNT NOT TO EXCEED $670,000 FROM UNALLOCATED HOMELAND DEFENSE/NEIGHBORHOOD IMPROVEMENT BOND PROCEEDS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ordinance No. 12451, the Capital Projects Appropriations Ordinance, adopted November 25, 2003; and WHEREAS, pursuant to Ordinance No.12137, adopted October 11, 2001, the amount of $10,000,000 is earmarked for the Bicentennial Park Improvements Project ("Project") from the Homeland Defense/Neighborhood Improvement Bonds ("Bonds"); and WHEREAS, only $5,000,000 is available for said Project from the first series issuance of the Bonds; and WHEREAS, it is necessary to reprogram an amount not to exceed $1,200,000 from Capital Improvements Project ("CIP") No. 311613 and appropriate available Bond proceeds in an amount not to exceed $670,000, for a total additional appropriation in an amount not to exceed $1,870,000, for the Bicentennial Park Improvements Project, CIP No. 331418, to award the shoreline stabilization construction contract at the low bidder's quoted amount; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 12451, the Capital Projects Appropriations Ordinance, adopted November 25, 2003, is amended in the following particulars: {1} Ordinance No. 12451 City of Miami Page 1 of 3 File Id: 04-00120 (Version: 2) Printed On: 8/30/2016 File Number: 04-00120 Enactment Number: 12487 Section 1. The herein appropriations are herby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during Fiscal Year 2004. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior funds. The sources of revenues to support the herein appropriations are hereby identified by fund and project in ten Capital Funds, as follows: Appropriations II. All ordinances or parts of ordinances, insofar as they are inconsistent or in conflict with the provisions of this Ordinance, are repealed. Section 4. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is dispensed with an affirmative vote of not less than four -fifths (4/5ths) of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon adoption and signature of the Mayor.{2} Footnotes: {1} Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
