HomeMy WebLinkAboutVariance AnalysisAnalysis for Variance for the Tower Twenty Seven MUSP located at 2700, 2730, 2742, 2744 & 2746 SW 27th Avenue Case No. 2003-0730 Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for Variance as follows: Building Footprint: Required - 33,802 Sq. Ft. (40%) Proposed - 45,435 Sq. Ft. (54%) Request to Waive -11, 633 Sq. Ft.(14%) The following findings have been made: • It is found that the proposed mixed -use project will benefit the area just north of the US-1 next to the Coconut Grove Metrorail Station by creating new residential units along 27th Avenue and 27th Court. • It is found that the project has a townhomes villas component along 27th Court, which directly responds to the housing type (Duplex) across the street. The size of subject property and its and location would not allow for those townhomes villas to be built unless this footprint variance is granted. In order for the applicant to provide good urbanism on such an important street and respond to the Planning and Zoning Department Internal Design Review Committee comments for such good urbanism practices, the requested footprint variance is needed and will be justified. • It is found that granting of this variance will not have an adverse effect on the adjacent area due to the particular nature of the use proposed. • It is found that the grant of this variance, for the uses that the applicant is requesting, is in harmony with the general intent and purpose of the R-2 "Two Family Residential" district and is not injurious to the neighborhood. Based on these findings, the Planning and Zoning Department is recommending approval of the application as presented. Special conditions are result of petitioner's actions. Literal interpretation of ordinance causes undue hardship on petitioner. Granting variance conveys same treatment to owner. Variance, if granted, is the minimum variance for reasonable use of property. Is in harmony with general intent and purpose of ordinance.
