A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING A CAP ON THE USER FEE OF $5,000 AND A MAXIMUM OF
1,500 COMPLEMENTARY TICKETS FOR THE UNITED STATES SOCCER
FEDERATION, INC. FOR THE PRESENTATION OF A SOCCER MATCH AT THE
ORANGE BOWL STADIUM ON MARCH 13, 2004, BETWEEN THE UNITED
STATES AND HAITI ("EVENT"); CONDITIONING SAID AUTHORIZATION UPON
THE ORGANIZERS: (1) OBTAINING ALL PERMITS REQUIRED BY LAW; (2)
PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES AND APPLICABLE
FEES ASSOCIATED WITH SAID EVENT; (3) OBTAINING INSURANCE TO
PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY
MANAGER OR DESIGNEE; AND (4) COMPLYING WITH ALL CONDITIONS AND
LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY MANAGER OR
DESIGNEE; AUTHORIZING THE CITY MANAGER TO EXECUTE A USE
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM.
WHEREAS, the Department of Conferences, Conventions and Public Facilities seeks to enter
into a Use Agreement with the United States Soccer Federation, Inc. to host a soccer match
between the United States and Haiti to be held at the City of Miami Orange Bowl Stadium on
March 13, 2004; and
WHEREAS, the Department of Conferences, Conventions and Public Facilities recommends
the following special rates and conditions be approved:
1. User fee to be capped at $ 5,000 versus the 10% gross ticket sales
established in the Code of the City of Miami, Florida, as amended.
2. City of Miami ("City") shall permit the promoter to utilize a maximum of
1,500 total number of tickets for the event, which shall be authorized as
complimentary tickets for promotional purposes; and
WHEREAS, the event organizers will pay for all necessary costs of City services and
applicable fees associated with the event.
WHEREAS, this event will generate an economic impact on the community which is expected
to produce net revenues for the City in excess of $80,000, which includes revenues derived from
the Use Fee, Ticket Surcharge, Concessions and Parking.
THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. A cap on the User Fee, at the amount of $5,000, for use of the Orange Bowl
Stadium ("Stadium") for the presentation of a soccer match between the United States and Haiti,
to be held on March 13, 2004, and presented by United States Soccer Federation, Inc. is
authorized.
Section 2. The herein authorizations are conditioned upon the organizers: (1) obtaining all
permits required by law; (2) paying for all necessary costs of City services and applicable fees
associated with said event; (3) obtaining insurance to protect the City in the amount as prescribed
by the City Manager or designee; and (4) complying with all conditions and limitations as may be
prescribed by the City Manager or designee.
Section 3. The City Manager is authorized{1} to execute a Use Agreement, in substantially the
attached form.
Section 4. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
